GRAND RAPIDS, MI The action taken by a New York City police officer against Eric Garner is "clear," writes U.S. Rep. Justin Amash on Wednesday.
The incident was captured on video, showing Garner talking with police as they suspected him of selling tax-free cigarettes. The 43-year-old man then is overcome by officers who take him down to the sidewalk. Garner cried out, "I can't breathe," several times before becoming motionless.

When the officers outnumber a misdemeanor offender who is not armed, killing the offender in the course of the arrest is at the least negligence, which appears to be the case. Some states criminalize the negligent taking of a life-I don’t know about New York.
How do you arrest someone the size of a sumo wrestler who doesn't want to cooperate?
So it wasn’t the methods they used to arrest him that killed him, it was the reason for the arrest that killed him?
So if they were arresting him for some other reason he wouldn’t have died?
Amash is a freedom loving libertarian.
He is one of the few members of the House who stands up to Boehner.
Justin Amash is one of the five percent of Republicans in Congress who are real conservatives.
It was an accident and when accidents involve death charges are filed most of the time.
It appears there may be an execption here for a unionized cop in a big city whose union is tied at the hip to politicians......
Interesting that Amash is commenting on this and an interesting thread.

As for transparency on his votes, Amash is OUTSTANDING.
Thanks for posting, Bettyprop.
Thanks for the ping, ‘creek. My comment above.
Another cowardly conservative grabbing his Ferguson Moment sad but true. This jackass didnt hear a single word of testimony but he KNOWS all about what happened and the racist jury got it wrong really?
The owner of the store called the police because the perp (Garner) was harassing the customers and employees of the establishment.
Four police officers were dispatched to the scene because they knew there was going to be trouble with this guy. He had more than 30 prior arrests and was out on bail from his last arrest when this incident occurred.
Eric Garner may be a martyr to someone's cause, but he was a troublemaker and a useless oaf. He was destined to face a demise like this, sooner or later.
This administration? Try many FREEPERS who are ardent cop haters, demonizing them at every turn. Yes, they post frequently.
Yes, likely some got caught where the’d wished they hadn’t.
Yes, the police must decline to arrest them if they don’t feel like being arrested that day if they are black. If it’s anyone else the police may go ahead and do what civilized societies do and take them into custody. That’s what the new rules will be.
Correct - but that doesn't take criminal negligence off the table.
Amash is a libtardian moron.
I agree and think it was murder in this case.
“Stopping someone over something as inconsequential as a cigarette tax is stupid enough to begin with. Using such force over it is absurd.”
Every law passed can ONLY be enforce via such force. There is no other recourse left to the government to address any individual that refuses to obey ANY law.
Keep that in mind as we draw nearer and nearer to full implementation of Obamacare. They MUST be willing to kill any individual not willing to participate in their mandated market....like me.
No big surprise, he’s a CINO and a RINO.
The House on Friday passed a bill to approve construction of the Keystone XL pipeline hours after a Nebraska court ruled in favor of the proposed route. The legislation now goes to the Senate, where it is expected to be approves. The White House has warned President Obama would veto the legislation. Passage fell largely along party lines, 266-153, with 28 Democrats joining nearly all Republicans in favor. Rep. Justin Amash (R-Mich.) voted "present." That is short of the necessary two-thirds majority needed to override a veto. [House Approves Keystone XL Pipeline]
...legislation sponsored by Rep. Bill Cassidy (R-LA) which approved construction of the long-delayed Keystone XL Pipeline... 31 Democratic representatives voted with every Republican member of Congress save Rep. Justin Amash (R-MI), who voted present, to approve construction of the pipeline. [31 House Democrats join GOP in vote to approve Keystone]
