Staten Island's top prosecutor did not ask grand jurors to consider a reckless endangerment charge in the chokehold death of Eric Garner, a source familiar with the case told NBC 4 New York.
District Attorney Daniel Donovan only asked grand jurors to consider criminally negligent homicide charges against NYPD officer Daniel Pantaleo...

Glenn Beck, Charles Krauthammer, Andrew Napolitano and many others may have been right that there should have been an indictment.
Would that not be double jeopardy?
I don’t know what to think of this matter, I have seen the video, but there is so much more relevant information which has not been released. Like this fellow’s specific medical history.
But, ignoring all that, and just supposing that a reckless endangerment charge had been submitted, and that the grand jury said no to all other charges, and yes to reckless endangerment, does anyone think the public protests would be any different?
...
I didn’t think so.
Grand juries are not criminal trials.

When a prosecutor doesn’t want an indictment, he’s not going to get one.
There was an exception a few years ago when a grand jury indicted some public officials for crimes the prosecutor didn’t even present. That jury figured out the scam.
I know that, but forgive my ignorance—are multiple grand juries called for single offenses? If so, why?
Jeopardy does nor attach until a trial jury is sworn in.
No.
There was a prior grand jury ruling where a police officer was not indicted. I don’t remember all of the particulars, but I do remember that someone on CNN said that a judge ordered it to go back to another grand jury trial because he said that lies were told when testimonies were being taken.
I’m not sure if that is the only reason a 2nd grand jury trial can be ordered by a judge...
Grand jury is not a trial
They can reconsider
For many reasons
Or go Federal
I am not keen on retrying acquitted folks for federal civil rights
Its never been fairly applied and smacks of double jeopardy
The feds use it to circumvent jury nullification when victims are black
If I’m wrong about grand juries being one shot I’ll stand corrected
I saw this talked about on Fox News if I am not mistaken or was it CNN? I watch shows on both of them as long as it isn’t a blatant establishment host that is on.
Was she one of those that helped in the submission of Eric Garner or was she watching? If she was watching, I wonder what her seniority was compared to those who helped in the submission of Eric Garner.
Yep, corruption, not because of race, but to protect the “thin blue line”.... This stinks to high heaven.
The officers were using standard police take down procedures. I suspect that at the time of the take down that the officers were not aware of his weakened physical condition.
The medical history for Eric Garner seems to be leaking out.
I honestly think that he should have been ticketed and that alone.
They knew his name, where he lived, next of kin, etc, etc, as he had already been arrested before for selling loosies - so there was no reason why they couldn’t have just given him a ticket and be done with it - like they will do for those caught with small amounts of marijuana.
A guest on CNN (a law enforcement officer) said that this came down to “quality of life” police enforcement.
Fourth, ask any cop... the first thing people say when they're cuffed is "I can't breath"because they aren't used to having their hands behind their backs, causing pressure on the chest.
It’s funny but I live on Staten Island and I don’t remember Glenn Beck, Charles Krauthammer or Andrew Napolitano showing up at the grand jury hearing or having heard a single word of testimony but they KNOW the cop should have been indicted. Each of them is grabbing at their own “Ferguson Moment” to make themselves feel better.
