Grand Jury Declines to Indict NYPD Officer in Eric Garner Chokehold Death: Sources

A New York City grand jury has declined to indict an NYPD officer in the chokehold case of Eric Garner, the unarmed man who died while being arrested on Staten Island earlier this year.

In opting not to indict, the panel determined there was not probable cause that a crime was committed by NYPD officer Daniel Pantaleo, who was seen on a widely watched amateur video showing him wrapping his arm around Garner's neck as Garner yelled, "I can't breathe!" during the summer altercation.

Elsie, once again, we are BLAMING THE VICTIM. Possibly he meant to say that HE WAS HAVING DIFFICULTY BREATHING but he really didn't have time to think about how his words would be used against him after he was dead.

Be careful interpreting other people's words. In this crap society that Obama created, your words could be used against you someday.

Brown: justified Garner: unjustified and that one's not over...

Come on, people. Bad cops kill people of all color but you don't hear about it. And, those of you who continue to pretend that you are the medical examiner, GROW UP. There was enough compression on that man that he did stop breathing and died. It is the height of arrogance to use a man's DYING WORDS against him. I don't care how many times he told them he didn't want to go to jail. It's not a crime punishable by death to stand there making a statement and the victim was calmly stating he didn't want to go to jail. He made a mistake and thought some of those cops were his friends and he could trust them. Not in Obama's America.

Uncle Miltie, they executed him and if people don't believe that, hello, do they have racist tendencies? SHAME ON YOU if you do.

I agree. Instead of significant issues* (which cross racial lines) being addressed, we get inflammation of racial tensions.

It’s also sad that I counted 5 cops in the video. I wonder what else went down (probably within blocks of this incident) while Garner was being busted (fatally) for selling a few cigs. Talk about misplaced priorities...

*These cases of police “going nuclear” when there are clearly better ways to deal with the situation, are very troubling. Even the Ferguson case is troubling - evidently Michael Brown charged Officer Wilson from as far as 50 ft. away. Why did not Wilson have the means and training to take Brown down, perhaps seriously wounding him, without killing him? In the Garner case, there was NO need to tackle him at that point. To make matters worse, we have the “cops can do no wrong” crowd, who evidently did not read the Coroner’s report and / or certainly must be viewing a different video than the one I’ve viewed several times now, quite carefully.

I don’t think the cops intended to kill Garner — saying so is hyperventilation on the other side of things. But this was a homicide, as the Coroner made clear, and IMO, was unnecessary and a result of poor training.

Probably not before the cops tackled him.

Virtually all the police I’ve ever had to deal with are “good cops”. But, I have witnessed it going the other way myself — and it was a very good thing that the State Trooper who showed up to take charge of the situation did so, magnificently, and with great restraint on his part, I might add.

“Selling untaxed cigarettes should not get you the death penalty.”

Every law passed can only be enforced at the threat of government guns! There no law that is not ultimately enforcable via the use of those guns!

Everyone needs to be reminded of this whenever they are discussing any new law “for our own good” or “for da chilrun.”

“And no, I have never been arrested because I really have not broken any laws, yet.”

I’d wager that you actually commit a felony a week, without even realizing it. There is no way for you, or me, to know if we are being completely law abiding. There are simply too many laws and regulations at all levels of government for us to obey every one of them.

I’d even wager that if we are certain to be law abiding with regards to one set of laws/regulations, then that likely means that we are actually breaking another set of laws/regulations.

The video shows that the police killed this man. Was it necessary to continue choking him. For God’s sake it was 5 against 1.

I agree. All conservatives should mistrust police as a natural knee jerk reaction. They are a essential evil we endure to a civilized nation, but we don’t want them using that sort of force against us.

Those cops just got off with at least manslaughter if not 2nd degree murder. Disgusting.

Well, I have never broken a law that I was arrested for or that I knew was breaking the law.

But...I get where you are coming from. It is ObamAmerica now.

Elsie, once again, we are BLAMING THE VICTIM.

What BLAME?

I merely pointed out how hard it is to talk and yet not breathe.

Be careful interpreting other people's words.

Good advice.

“The cop used an illegal choke-hold and someone died as a result and the cop won’t be charged with a crime.”

Not illegal. Against policy but not against the law.

The criminal decides how much force must be used by the police to effect an arrest.
