Law360, Los Angeles (September 24, 2014, 8:44 PM ET) -- The Seventh Circuit ruled Wednesday that it is up to Wisconsin state courts to decide whether an investigation into potential campaign finance violations involving Gov. Scott Walker and a host of conservative groups should proceed, overturning a lower court injunction that halted the probe on First Amendment grounds.
A three-judge panel called the injunction issued in May by U.S. District Judge Rudolph T. Randa an "abuse of discretion," saying that "this case does not present a situation in which state proceedings may be displaced."
The panel directed the lower court to dismiss a suit filed by Wisconsin Club for Growth and political strategist Eric OKeefe, "leaving all further proceedings to the courts of Wisconsin."
However, the decision doesn't allow prosecutors to immediately restart the once-secret "John Doe" investigation, as Wisconsin state Judge Gregory Peterson in January quashed several subpoenas issued at the behest of special prosecutor Francis Schmitz. Judge Peterson ruled that the evidence isn't necessary to the investigation, in part because Schmitz didn't establish a solid basis to show that a violation of state law occurred, according to court documents. That ruling is currently being appealed at the state level.
Think the Wisconsin liberals are gonna let this Christmas gift go unwrapped? The whole month of October will be filled with this crap as the Dems in that state will do any and everything to beat Walker and get their power and control to the state treasury back. But I don’t know what the word “defeat” even means anymore in post-coup America. If by defeat, you mean defeat them at the polls, then that is pretty much useless. The old tricks of having the judiciary and an entrenched bureaucracy have now matured into having local “prosecutors” who raise bogus investigations to enforce laws that are re-written at a whim by the courts. When the opposition is criminalized, there is no opposition.
I fear we are reaching a point where we will witness why the left fears the Second Amendment.

The only good news here is that the State Courts also halted this investigation as well as the Federal Courts and the 7th Circuit only was able to lift the Federal Court injunction. The Republicans (via the Wisconsin Supreme Court) have the trump card in keeping it halted.

Even the worst of the worst BLUE Counties are seeing their Unemployment numbers improve. Dammit! How are they gonna keep voters when ‘Da Man’ is actually finding them JOBS and a way OUT of those Hellholes?

But it still had a significant .5 percent drop during the month.

He handily won his recall with MILLIONS more in votes the second time around. I’m pretty sure turn out is going to be HUGE here in November; not counting dead and incarcerated ‘Rat voters, of course! ;)

We are still fighting for Scott. Unless the unionists from IA/MI/IL/MN get by the voter ID filter, and register as WI residents in order to vote, we should have a decent chance to prevail. Remember, AFSCME has a “score to settle”. Giving the power back to the people, and yet, allowing collective bargaining on wage issues only seems to be a step too far for them. I am a public employee, and I have no problem with ACT 10. We’ll see.....
I saw the current polling numbers, I forget them now and don’t want to say anything sounding overly optimistic but I think Walker is up by 5 points or more.
