White House To Ignore Court Ruling, Keep Handing Out Obamacare Subsidies

The Obama administration will continue handing out Obamacare subsidies to federal exchange customers despite a federal court’s ruling Tuesday that the subsidies are illegal.

A D.C. Court of Appeals panel ruled Tuesday morning that customers in the 36 states that didn’t establish their own exchange and use HealthCare.gov instead cannot be given premium tax credits, according to the text of the Affordable Care Act itself. But the White House said in response that it will continue handing out the billions of taxpayer dollars in subsidies. White House press secretary Josh Earnest said that while the case continues to be battled out in the courts, the administration will continue to dole out billions in tax credits to federally-run exchange customers.

If only Republicans would do the same when some Lib court imposes gay marriage in a conservative state. Is it any wonder we are losing the war on cultural and spending issues? The Dems do what they want, law and courts be damned. Republicans play by the rules even when the deck is stacked against them.

It will be interesting to see what Obama does if the Supreme Court rules against him on this one. Just ignore them and keep doling out the money?

Since the matter isn’t settled, there’s no legal impediment to them continuing the subsidies.

The downside is that if the ruling by the 3-judge DC court panel is upheld, people are going to owe the subsidies back as overpayments. Given the use of the big insurance companies as middlemen, it’ll get very, very messy.

While Obama deserves no slack, if it hasn’t already, the Court of Appeals will most likely stay their ruling (so it doesn’t go into effect immediately) while it is appealed. It happens all the time.
