Refuse an alcohol breath test July 4? Expect to give blood

EUGENE, Ore. - If you refuse to take an alcohol breath test this Fourth of July weekend, be prepared to give blood.

Eugene, Springfield and Oregon State police plan a "No Refusal Weekend" over the Independence Day holiday.

Police plan to work in coordination with prosecutors and judges to quickly obtain "blood draw warrants" for drivers who refuse blood alcohol content testing.

Should this be considered an unreasonable search, and constitute a violation of the Fourth Amendment?

The Irony to do this on the 4th of July of all days.

The US Supreme Court has affirmed this. They have instant court orders from a judge on this, so it passes Constitutional review.

That’s what makes it Constitutional ... the judge’s warrant makes it pass Constitutional review.

We were told it was voluntary then.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

It depends on where you are and what mischief you’re up to. If you’re at your own home you shouldn’t have a problem. Go driving and hit someone you go to jail. Start screaming from your porch and become a loud drunk and a nuisance you might go to jail.

The question almost seemed to be a “bait” question to get FR’pers to spiel 4th amendment protections to make them say something stupid that would make them look bad and help the DemonRats and the liberals.

The Supreme Court ruled on the Constitutional issues ... :-) ...

If citizens want to take it beyond that, then they’ll have to get a Constitutional Amendment passed to undo the US Supreme Court decision.

Don’t think he’s defending the SCOTUS view, just stating a fact: that nobody is going to stop police from doing this, because of the SCOTUS decision on its Constitutionality. You see the difference, right?
