BEN SHAPIRO'S OBAMA SOLUTION: 'PROSECUTION NOT IMPEACHMENT'

On Thursday, Senator Marco Rubio (R-FL) stated that he was "not, at this point, calling for impeachment." He continued, "The president has two years left in his term. We hope they pass quickly."

That hope is empty. They will pass slowly. And even should Republicans win back the Senate in 2014, President Obama promises heavy executive action--action that will surely violate the Constitutional delegation of powers.

Which is why, says Breitbart senior editor-at-large Ben Shapiro, impeachment isn't the answer: prosecution is. And in his new book, The People vs. Barack Obama: The Criminal Case Against The Obama Administration, Shapiro lays out the charges.

"A criminal administration can do virtually anything, without any sort of real consequences," Shapiro writes. "Impeachment is rarely used - in the entire history of the United States, there have been just 19 House impeachments, and just eight of those ended with full removal after a Senate trial. No doubt the founders intended impeachment to be utilized far more often than it has been...But in practice, impeachment has been a failure."

Instead, Shapiro proposes, criminal prosecution of the Obama administration under the Racketeer Influenced and Corrupt Organizations (RICO) Act should be on the table.

That act was created as a response to the mafia--it was designed to undermine mob claims of plausible deniability. It was created to hold command and control structures accountable for activities taking place down the chain. Shapiro writes, "Congress expressly worried in the RICO law itself that organized crime was using its money and power to 'subvert and corrupt our democratic processes.' Those worries were understated. Now the chief threat to the democratic process comes not from the mafia but from within the government itself."

Rubio is not a “bad” guy, but he is disappointing as a tea party candidate. So is Rand Paul and Tom Cotton, and a few others. I know it is very difficult to judge one’s character, but there are some people who really have a knack for it. We need these kinds of people working within the network that can sift out those who talk the talk, but don’t walk it. That takes time. But it is a necessary thing. If we don’t vet these candidates better, we’ll have more egg on our face than an omelet. Personally, I’m getting very frustrated with those who want tea party support, but then want us to keep away from them after they are in office...the “let us alone” crowd...that once elected, have better things to do than keep their promises. You will always have a few losers, but they need not be the majority. We can do better.

Refusing to vote for the lesser of two evils, by definition, supports greater evil.

“The Founders intended the representative of the people and states, in Congress, to be in ultimate control of the government.”

The impeachment process is intended to determine whether or not the impeached government officer may continue in a government office with its attendant powers and authority, but it is not intended to provide criminal trial and punishment for criminal felonies beyond the punishment of removal from office.

I'm sure the NDAA language would snare Barry as aiding and abetting (if the sitting Preezy isn't explicitly excluded), but the larger question would be whether the DOJ would even allow such a charge to be brought. Me thinks: Eric would never allow it.

True.

Should note that even if legally justified, pursuing an impeached or term-expires president with criminal charges would have serious negative long-term consequences for the country. Might very well not be worth it except in the most extreme circumstances.

If Ben Shapiro would start bringing people's attention to the Constitution's Clause 2 of Section 7 of Article I for the 2014 elections like Glenn Beck should have done for the 2010 elections, then Obama possible wouldn't be president at this time.

Clause 2 referenced above gives Congress the power to override presidential vetoes if 2/3 of both Houses agree to do so. In other words, Congress could repeal constitutionally indefensible Obamacare Democratcare without Obama's signature if patriots and former Obama supporters got their acts together and elected the right people to Congress in 2014, 2010 and 2012 being missed opportunities.

And although there are doom-and-gloom freepers who argue that a split Congress could never override a president's veto, Congress has exercised Clause 2 as recently as Bushes 41 & 43, and also with Clinton.

But so-called "conservative" celebrities like Beck, Shapiro, and Obama guard dog Fx News remain silent about Clause 2 which isn't helping the nation.

Democrat Party is no longer the same as before. Not, it's full-steam socialist/Marxist 24/7/365 + 1/4 day.

Republican Party is not as grassroots-friendly as it once PRETENDED to be.

Constitutional conservatives are desirous of getting back the Country we thought we had but apparently didn't and are being thwarted from all directions.

And lawlessness abounds in the highest places and throughout the Nation. We either return to trusting in God from our heart of hearts, or we will be enslaved even more than we are now. Well, our children and their children will be.

Your clock ends with the 2016 election. Unfortunately, nobama will continue to wreak havoc with our precious country until around 1pm on Jan 20, 2017.

And that time may be the most dangerous time. That is traditionally when exiting presidents issue pardons and make all sorts of last minute proclamations, etc.

This damnable priviledge of blanket Presidential pardons must end--for ALL Presidents. It is abused often and has brought about a hopelessness for those who expect the the Rule of Law applies to ALL AMERICANS!

A few months ago, The Daily Caller posted an article on the internal executive power struggle at Breitbart.

One of the their senior executives had boasted, at an earlier time, that he had voted for Obama in 2008.

I suddenly remembered that as I was about to post on this thread.
