Lumber Union Protectionists Incited SWAT Raid On My Factory, Says Gibson Guitar CEO
Forbes ^ | May 26, 2014 | Forbes Op/Ed

“Henry. A SWAT team from Homeland Security just raided our factory!”

“What? This must be a joke.”

“No this is really serious. We got guys with guns, they put all our people out in the parking lot and won’t let us go into the plant.”

“Whoa.”

“What is happening?” asks Gibson Guitar CEO Henry Juszkiewicz when he arrives at his Nashville factory to question the officers. “We can’t tell you.” “What are you talking about, you can’t tell me, you can’t just come in and …” “We have a warrant!” Well, lemme see the warrant.” “We can’t show that to you because it’s sealed.”

While 30 men in SWAT attire dispatched from Homeland Security and the U.S. Fish and Wildlife Service cart away about half a million dollars of wood and guitars, seven armed agents interrogate an employee without benefit of a lawyer. The next day Juszkiewicz receives a letter warning that he cannot touch any guitar left in the plant, under threat of being charged with a separate federal offense for each “violation,” punishable by a jail term.

Seals issue their own warrants.

I'd like to use the well-worn cliche, ‘This is not America’ ... But sadly these stories are too common place. We have a government royalty, and their armed brownshirts, running amok and crushing whomever their whims direct them to crush.

Sealed Warrants are freely available to all DICTATORS.

The warrant was baseless, and the use of SWAT is tyranical over reach.

WTF does “Homeland Security” to do with ANY aspect of this fraudulent use of force?

I would visit another wood supplier and buy an inventory of Louisville Sluggers, prior to a little “Union Meeting”.

“As a result, just about any businessperson, especially in highly regulated industries, can be construed by a prosecutor to have committed three or four arguable felonies a day.”

Kinda chilling.

You know, come to think of it, these Fascist Obama years are a lot like the 1930’s in Hitler’s Fascist Germany - - - - - .

Just like in Atlas Shrugged - they don’t want you to obey the law, they want you to be a lawbreaker so they can control you.

Apparently the courts are now allowing sealed warrants and secret evidence and where you can be imprisoned for breaking a law that you didn’t even know existed. Welcome to Amerika.

Hell, our government has been in the EXTORTIONIST business since 1972 - thanks to Nixon’s OSH Act! If OSHA wants to fine you, they can and WILL fine you - PERIOD!

People really don’t know how petty the current laws can be read and applied. If you have a household microwave at your office, you can be FINED! If you have normal household coffee pot at your office, you can be FINED! Simple little, petty things for which probably 95+% of the companies in America can be and HAVE been fined and cited!

Hell, the way the law is written, even if you follow the law EXACTLY as written, OSHA can still fine you if they feel you didn’t do “enough” to “protect your employees!” Even worse, once cited you MUST pay the fine or spend lots of money suing OSHA - either way, they will extract money from your company and harm you and your business!

The alphabet soup agencies MUST be curtailed, or better yet DROPPED! I truly believe Americans have no idea how little effect there is in changing politicians, if they are not serious about getting all the self-serving bureaucracies under some serious control!!!

My company does HIPAA compliance for healthcare companies. Very highly regulated.

Not a single company I’ve ever seen is fully compliant. Some come close but it is very expensive and difficult.

Sealed warrants are hardly distinguishable from Geo. III's Writs of Assistance that were a major sore spot with the Colonials. Cf. James Otis, 1761

Back in the late 1980’s, my company placed me in charge of MSDS. One day, when I was trying to track one down for sawdust, I said to myself, “the heck with it” and quit.
