Students in a California school district will not be allowed to wear American flag T-shirts on Cinco de Mayo, due to concerns that such displays of patriotism would inflame racial tensions by offending Mexican students on their holiday.
The districts policy concerned many free speech advocates, but was upheld by the Ninth Circuit Court of Appeals.
In response, Tea Party groups plan to protest outside Live Oak High School in Morgan Hill. And they will be wearing American flag T-shirts.
They silenced a symbol of patriotism and freedom in America, said Georgine Scott-Codiga, president of the Gillroy-Morgan Hill Patriots, in a statement to KCBS.
The trouble dates back to Cinco de Mayo in 2010, when the school forced four students to remove their American flag T-shirts. Administrators worried that fighting would break out between white and Latino students if the shirts were noticed, and so the four offending students were sent home.
The practice of limiting one groups free speech rights because that speech might cause another group to react violently is known as the hecklers veto. It is understood by free speech enthusiasts to have a chilling effect on First Amendment rights.
The Ninth Circuit, however, ruled in February that the school was legally permitted to abridge white students free speech rights in service of Latino students feelings.
The Tea Party protest is focused on the free speech issue, said Scott-Codiga.
Police will being standing by in case things get out of hand.

About 30 protesters holding American flags are silently standing outside of Live Oak High School on the anniversary of a controversial incident that gained national attention.
The protesters have indicated they wont have anything to say until classes start at 8:15 a.m.
Students arrived at school under tight police security, four years after a small group of Live Oak students came to school on Cinco de Mayo wearing American flag T-shirts, saying it was a sign of their patriotism. Latino students felt it was a sign of disrespect. Administrators told the students to wear the T-shirts inside out or go home.
Just remembered that it was the Argentine cruiser General Belgrano that the Brits sank in May 1982. Thus it was their “sinko de belgrano.”
This sort of stuff just makes blood shoot from my eyeballs. GO HOME to Messy-co if you want to celebrate independence from Spain.
It is NOT our holiday. Heck, the majority of Messy-cans have no damn idea what Cinco de Mayo is all about.

The students were wearing shirts with the representation of the U.S. flag, not wearing U.S. flags made into shirts.
