The Supreme Court 'Sounds Ready' To Throw Out A Controversial Part Of Obamacare

The Supreme Court sounded "ready" to throw out the part of the Affordable Care Act that requires certain religious corporations to offer employees contraceptive coverage, according to a report in The Los Angeles Times.

The court's conservative justices were sharply critical of the provision in the law. The women justices, meanwhile — liberals Elena Kagan , Sonia Sotomayor, and Ruth Bader Ginsburg — defended the law, according to the Times.

Justice Anthony Kennedy, a swing voter with a libertarian bent, told U.S. Solicitor General Donald Verrilli, who defended the mandate, that his reasoning " would permit requiring profit-making corporations to pay for abortions."

The rule at stake under the health-care overhaul is a provision in the ACA that requires all new health insurance plans to pay for contraceptives. The issue is whether for-profit corporations — in this case, the lead plaintiff Hobby Lobby Inc. — can refuse to provide all or some contraceptive services.

That’s where we are today. We will see what really happens after the decision. Don’t be shocked if we find out Judge Roberts is trying to gum up the works once again. I do expect him to try. Obama obviously ‘has something’ on Roberts. Like before, we will never know why he screwed up the Amercian people’s legal system.

Common sense says the court should throw it out. But common sense said the court should not have allowed HusseinCare to ever become law in the first place. I’ll believe it when I see it.

I don’t think they can throw out part that act. I believe it was explicitly made not severable.

Political theatre. We have no idea what the 9 political hacks in black muumuus are going to do. Although it’s a pretty fair bet that whatever they do will be contrary to the Constitution, common sense, fair play, and the economic interests of the middle class.

Hard to take their reporting seriously when they don't even understand the plaintiffs case. The case is not about contraceptives. The case is about abortifacient drugs at a micro level. It is about freedom at a macro level.

Predicting what these robe wearing swamis are going to do is about as productive as trying to pour hot butter up a bobcat's ass.

The (female only) contraceptive mandate isn't law, it's a rule promulgated by an executive department, the Department of Health and Human Services.
