The Supreme Court appeared likely Monday to say that states cant rely on intelligence test scores alone in borderline cases to determine that a death row inmate is mentally able and thus eligible to be executed.
The justices heard arguments on a snowy morning in a challenge from a Florida inmate who says there is ample evidence to show that he is mentally disabled and protected from being put to death, even though most of his IQ scores have topped 70.
That score is the widely accepted as a marker of mental disability, but medical professionals say that test results have a margin of error and in any case are just one factor in determining mental disability.

This shows enough IQ to me.
If my life was on the line, I’m sure I could test out at 65 or so, especially if I had library access and could research Sanford-Binet or whatever test they use.
Heck I can get witnesses right now who will swear that even 65 is optimistic for me (hear that, peer reviewers?).
If your life depended on it, do you think you could score below 70 on an IQ test?

I thought the left’s position was that IQ tests were culturally and racially biased and were invalid on that account. Now they’re saying these invalid tests must be given weight in deciding sentences? I’m stunned...not.
More proof-positive that the elites are in the process of administering a death sentence to the death penalty.
Sure, it’s on the books and you can impose it. But with endless rounds of appeals on issues like this, plus the fact that pharma won’t sell you execution drugs anymore, and it’s becoming clear death row inmates are all going to die of old age.
Plus, being classified "mentally disabled" can result in more welfare benefits.
If that works we could decide that most of our government is too stupid to govern.
A quick test would be to toss a hard object at the guy’s head without warning. If he doesn’t react fast enough to catch it, he get’s a bruise and a life sentence. If he catches or deflects it; he avoids a bruising, but stays on death row.
There’s a fairly high correlation between reaction time and IQ as measured by psychometric tests. That’s because both IQ (as we understand it) and RT depend on speed of information processing.
If he gets hit and claims it was bad of you to throw the object then he understands right from wrong.
Anybody who can murder IS responsible. Put in an express lane, no speed limits.
The margin of error has been long held to be + or -1. Not much of a margin, but it stands. Still too stupid, (not disabled), to know better to not repeat violent offenses. It’s not how stupid or smart one is, but how one is stupid or smart. (Modified Steven Pinker definition of intelligence.) Off with his head!
