SPRINGDALE, Ohio (CBS Cleveland) Imagine going out of town to visit a dying relative only to come home and find a complete stranger living in your house; and worse, that stranger now says he legally owns that house.
WLWT-TV reported that Robert Carr moved into a house, changed the locks, and emptied the house.
Carr says he is able to claim the property through something called a quiet title. He says the family abandoned the house and gave up their rights.
Carr wants to keep the home and not have to pay a penny.
What hes looking for is full title and ownership of the home, Alison Warner, the familys attorney, told WLWT. Hes in their home. They dont know when hes there. He can be there now.
The family has charged Carr with breaking and entering but he is even fighting that charge.
A quiet title action lawsuit brought in a court over property disputes. It is used to establish who legally owns a property.
The FBI has been informed about this case.
Theyll come together as groups to receive training, how to conduct some of these schemes from a financial standpoint, to understand what they consider the common law and how they can use that common law for their sovereign purposes, Special Agent in Charge Kevin Cornelius told WLWT. Im not familiar with any cases where its held up in court. I think that it holds up the process of the courts decision.
The family in this case has called this ordeal a nightmare.
Its really been hard, the homeowner told the station.

A previous article quoted an expert to the effect that adverse possession is the only authentic legal doctrine under which this could be done.
But to take title by adverse possession, in most states, the claimant must prove he has occupied the property continuously for something like 15 - 30 years (depending on the state).

Now, about all you can do with someone like this is let him get away with it or kill him.
Ordinarily, that wouldn’t be a fatal shot. However, in Mr. Carr’s case you would also hit his head.

a double tap is what is required. the mistake is using a half measure, when a full measure is required.
Spray him with 3” #7 buckshot from a keltec bull pup and turn him into a sieve.
He’ll seek medical help, go to the hospital and while he is out you can change the locks, move back in.
I’d get five rottweilers from East LA on the property STAT and place two PHALANX Gatling guns on the roof.
One on the NE corner, the other on the SW corner.
Then install Fort Knox doors on the front and back door.
Place two Claymores wherever someone can enter(remember to fsce them outward).
Should be good to go after that.

This is nonsense the person is engaged in trespass and fraud. Quiet Title does not give you the right to take someone else home, this person is going to go to jail for a long time.
This could have all been solved a long time ago with a simple scream of panic followed by some ventilation.
how does it get to this point. go to police and say my home, heres stuff with my address on it, this guy broke in. why is there even a discussion?
at common law, an adverse possession claim has several technical requirements and requires 20 years possession to ripen into a new ownership
(i do not know if Ohio has modified the rule or not, some states have lessened the 20 years requirement for instance...)
So where are the cops throwing this thief in jail? Carr isn’t a renter. This isn’t just a civil case. He destroyed this families property and took their home.
They need a better lawyer cause this is still ongoing.
Prior to shooting him we'd have to have a little talk about where he took my possessions.

Entitlement. Notice something about the criminal? Have anything to do with a “gibs me dat” mentality? Have anything to do with an eeevvvviiiilllll ‘oppressor’ and an innocent ‘oppressed’ person walking in and taking what is ‘rightfully’ his?
The fact that the police did not arrest him for breaking-and-entering, I would say there is more here than meets the eye.
