I used to feel that this was an outrage.
However, the roads don't have the "freedoms" that individuals have because we need a license to drive. Therefore, we agreed to be regulated when we got our driver's license.

So, the highway patrol and city cops can do what they do. I've been pulled over by cops for all sorts of things that I thought were odd. I always let it go because the THIN BLUE LINE is essential in this world and ... basically, better them than me. What a lousy job, dealing with scofflaws and thugs. NO THANKS.

That being said, they do annoy me sometimes; I'm sure the feeling is mutual.

Wasn’t there a story here on Free Republic earlier this year about a similar roadblock in Alabama where drivers were pulled over and offered money if they would give samples as part of this “National Highway Traffic Safety Administration” so-called study?

If you simply say “You have no probable cause. I will not” they say “OK be on your way” If you make an issue of it, curse or swear they have a cause and you can be charged.

I used to work for a city where the police would put up a big sign on I-20 the sign said “Stop for Breathalyzer and drug test” If you just drove by they just waved. Anyone who made a U-Turn across the median was stopped for reckless driving and gave the police probable cause

But, but, but, this is Texas, the Land of Milk and Honey! Like the song says Texas has Whorehouses in It,” and its called their Police Stations! All you Texas Freepers need to do some serious ass whooping on your cops. They make the rest of the country look good! Maybe not as bad as your “neighbor,” New Mexico, because I haven’t read that you are shooting at motorists yet!

Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics

Bivens v. Six Unknown Named Agents, 403 U.S. 388 (1971),[1] was a case in which the United States Supreme Court ruled that an implied cause of action existed for an individual whose Fourth Amendment freedom from unreasonable search and seizures had been violated by federal agents. The victim of such a deprivation could sue for the violation of the Amendment itself, despite the lack of any federal statute authorizing such a suit. The existence of a remedy for the violation was implied from the importance of the right violated.

Bivens has been subsequently interpreted to create a cause of action against the federal government similar to the one 42 U.S.C. § 1983 creates against the states.

They have road blocks and sobriety checks here in New Mexico all the time, but I’ve not heard of them giving breathalyzer and blood tests to everyone, just the people who appear to have been drinking or on drugs. When they find out how many people are driving intoxicated at any given time, what are they going to do with the information?
