A federal judge on Tuesday refused to dismiss a case that could fatally cripple the Obamacare health insurance law.
The Affordable Care Act forbids the federal government from enforcing the law in any state that opted out of setting up its own health care exchange, according to a group of small businesses whose lawsuit got a key hearing Monday in federal court.
The Obama administration, according to their lawsuit, has ignored that language in the law, enforcing all of its provisions even in states where the federal government is operating the insurance marketplaces on the error-plagued Healthcare.gov website.
Thirty-six states chose not to set up their exchanges, a move that effectively froze Washington, D.C. out of the authority to pay subsidies and other pot-sweeteners to convince citizens in those states to buy medical insurance. But the IRS overstepped its authority by paying subsidies in those states anyway, say the businesses and their lawyers.

OK, I’ll say it. Damn it! Where the Hell is the US press on this? Its getting really old getting USA news from the UK. Just WTF is going on here on our own soil? If I’m outta line I seriously apologize and but if I’m not outta line then who or what do we need to do to kick the MSM in the a$$ to get some REAL ACTUAL reporting regarding events here in the US to the American people. This business as usual crap is getting reaaly old really fast.

You might not lose it if you are a large group but what might happen is that your premiums, co-pays and deductibles will increase. For your own planning, you might ought to find out what state the policy is written in and what the mandates are for that state. They are all different which is one of the reasons why individuals trying to buy policies across state lines would be difficult, if not impossible.
Texas didn’t add any new mandates during the last Legislative session but if your policy is written in another state, might not apply to you. Unfortunately most people I deal with don’t have a hard copy of their benefit schedule or group contract. This is something I always recommend that people have in their files. When you are part of a conglomerate, it’s hard to figure out who really takes care of what.
There are no States, only the Obama Kaliphate.

If the language of the law specifically prohibits the government from enforcing the law in those states that did not set up their own exchanges, then it is a violation of the Separation of Powers.
The Supremes would likely go for a 9-0 shutout against Obama - just like it did [8-0, one recusal] in United States v. Nixon during Watergate.
Both of these cases go to the basic principles of our government. The Supremes will not allow a President to enforce his own guidelines beyond what is written into law. The Supremes have, however, allowed the President latitude in enforcing the law [eg: immigration] through prosecutorial discretion.
If the President wants to extend provisions of the ACA to cover states that are not entitled to it - Congress will have to revise the law ...
