Mercado was named in several prior complaints according to police Internal Affairs reports obtained by Reuters. He was disciplined for failing a drug test in 2011 but was exonerated in several other cases, including punching a man in the face during an off-duty fight in a men's room in 2007.

The cop isn't without issues and I think dying for graffiti is a tad draconian.

When tazers first hit the street cops told us they would only be used in leiu of bullets. This assurance was made because tazers do have the ability to kill, even if the probability is low. Now tazers are used to gain physical compliance, in the way batons were once used. Unless the police had a situation where bullets were appropriate the tazer never should have left the officer’s belt.

As of December 2012, roughly one million people have pacemakers in the United States. Pacemakers have progressed in the past years.

Although Tasers are non-lethal to the average human, for a big portion of our society they can be. Not only those with pacemakers, but others with undetected heart conditions can be killed by them.

In my opinion, and I’m the world’s foremost expert on my opinion, Tasers should be considered to be lethal weapons.
