About a half-dozen bikers accused of beating an SUV driver last weekend used their helmets to attack him and kicked his head and body as he lay on the ground, New York police said. Police said one of the bikers -- Robert Sims -- also stomped on the driver's head and body, according to a detective's criminal complaint. Sims was one of two bikers who turned himself in to authorities on Friday. He has been charged with attempted assault, gang assault and criminal possession of a weapon.

Of course it was an attempt to kill the driver, who would think otherwise?

An “attempted assault” means you missed hitting the person.
“Battery” is the actual criminal contact the assailant has with the victim.

Attempted murder sounds right to me too.
Every time I see Obama on TV I could be charged with attempted assault because that is sure what my thoughts are. Only the distance and half a million police are in my way.
I thought that a meaningful threat of violence, even without any actual attempt, was enough grounds for being guilty of assault.

Correct me if I’m wrong, but didn’t the driver of the SUV run down a couple of bikers and then drive away? Wasn’t that the reason for the assault?

No. He was trying to get away from them and they attempted to block him and he run over one of them in the process. Same thing I would have done.

Cruz pulled in front of him and stopped causing the driver to bump his tire. They then layed their bikes down in front of his vehicle to block him then attacked the vehicle with the driver, his wife and daughter inside. The driver’s only mistake was living in a fascist state and city that denied him and his family the right to protect their lives with a firearm. The video is clear.
A swing and a miss maybe?
The biker the SUV first hit did a break check in the middle of the road without considering his surroundings. The SUV driver wasn’t able to stop in time and slightly hit the bike causing the biker to lose his balance and sprawl on the ground.
THen the fight started...
