A Florida orthodontist sued the Obama administration on Tuesday, insisting that the White House must abandon changes it has made on its own to the Affordable Care Act, instead obeying the letter of the law as Congress passed it.
The administration has made several tweaks to the Obamacare law, including a one-year delay of a measure that requires companies with 50 or more employees to offer them health insurance or pay financial penalties.
The law specifies an exact date when that feature is to go into effect January 1, 2014 but the White House announced in July that it would push that date back, angering some in Congress who saw the move as a unilateral power grab.
The lawsuit, filed by Dr. Larry Kawa, claims that the regulatory changes violate the Administrative Procedure Act and go beyond President Obamas constitutional powers.

Why wait until today - ? Standing?
Now that it’s open?
glad to see someone getting after those criminals trying to ruin our country.
the law is supposed to be equal, this socialist health care is not
From article:
‘President Obama would delay the damage of his health care scheme until after the 2014 congressional elections,’ said the group’s president, Tom Fitton. ‘But politics do not trump the Constitution or the rule of law. And to paraphrase Ulysses S. Grant, the best way to ensure the repeal of a bad law is to enforce it vigorously.’
Along with that, revoke ALL the exceptions to the law that Barky has granted to his buddies. The law MUST be enforced as written.
I keep hearing Reid say “it’s the law of the land,” so it needs to be enforced as such.
Mark
Right On! The guy is Correct. Changes to the Law were not Passed and deemed Constitutional.
Yep. I look forward to a thousand similar stings.
Congress really needs to call Obama out on his illegal selective enforcement (read: changes) to Obamacare.
If they don’t stop him now, he’s going to continue to rewrite Obamacare in whatever ways he likes, to suit his redistributionist agenda.
That picture of Reid and Pelosi? Gross!!!
Aside from that - I commend him for trying. But with this Admin......sigh.
And PigFace is in it, too. Ack!
One was that there are now 1,472 waivers to 0Care...(where's our exemption?), and...that the law being rolled out today is NOT even the same law that was originally *passed* (forced). In other words, they're enforcing a law that was not even passed. It's really NOT the law of the land.
I looked for the tape of it, as it really deserves it's own thread. Amazing.
How do we join the suit? I, and I'm sure, millions of other conservatives would even contribute monthly to hire the best legal firms in the country to challenge unconstitutional overreach.
It's time that the elected criminals be held to account and be impeached or fired for gross abuse of citizens' Constitutional protections, under color of authority, or for mythical national security...
Does he have the standing to sue? I don’t see it.
“Congress really needs to call Obama out on his illegal selective enforcement (read: changes) to Obamacare.”
Dr. Kawa has it right. Have you noticed Boehner’s strategy is to demand the same treatment for individuals as what Obama illegally gave companies, rather than demanding Obama obey the law?
Have you noticed the strategy is a one year delay, pushing consequences past the next election?
Boehner is just Obama in a costume.
I wish it had worked that way with the IRS and taxes. They’ve just increased their encroachment over the years, unstoppable as a juggernaut.
I wish some of the most articulate speakers amongst House Republicans would hammer that point.
They swallowed the bait, not set the hook in deep. If this works out the GOP could be a majority party for a generation or more. We’re the party that cured the county of Obamanomics. That’s our legacy.
It’s fairly easy to go to a market based health care system from here. Just by using the Commerce Clause appropriately you can break interstate barriers to trade, allow people to buy insurance anywhere in the country, really the world and generate an enormous amount of competition in the healthcare market.
Remember you don’t need health insurance, just access to healthcare. Technology will solve a ton of these problems in the next five years or so.
Yep. That’s why I’d like to find the video of just that interview. It needs to be tweeted/emailed/FB’d to ALL Repub Reps.
Why not, as an individual he is required to either have adequate insurance or pay a fine. Nero exempted others. He is being treated differently.
