NEWINGTON When Andy Nowicki was a combat infantryman fighting the Germans in World War II, the army gave him free cigarettes.
Now, the habit he picked up 70 years ago, thanks in part to Uncle Sam, might cost him his home.
The Newington Housing Authority is suing to evict Nowicki, who will turn 90 next month, and his 90-year-old wife, Leona, from their senior housing apartment in Cedar Village.

I’m surprised the smoking didn’t kill him years ago.
Me too....and I understand your apprehension about the smoking inside stuff but he was trying to at least smoke outside, just not far enough away.
BTW, I don’t give them the satisfaction of calling them ‘cyclists’ because they use that term. I only use ‘bicyclers’ only because it pisses them off. The same goes for the ‘aliens helmets’ and the knee-length spandex panties (that one really pisses them off).
Can they perhaps get him a wheelchair so he can wheel himself the required 10 feet away from the building? Does this place have handicapped ramps? Whether he’s a veteran or not, rules are rules. Sometimes the rules are absurd, but still, if people start making exceptions for this person or that person, etc. what’s the point of having rules?
Didn't they make a movie about that? Punishing people for crimes they might commit at some future time?
I know I want you in those judges robes when my case comes up.
Second hand smoke and noxious, offensive odor.
Mr. Nowiki has at least two disabilities, lack of mobility and an addiction. Call ADA. Karp and Harvey have a legal responsibility to aid a person with disabilities, ie an electric scooter, a sheltered ramp, and a sheltered smoking area. Of course Mr. Nowicki will need someone to assist with his scooter. Come on Mr. Lawyer, lay it on Karp and Harvey.
I smoked Luckies in the old green and white pack from C-rats. Does anyone else remember LSMFT? loose straps and all that? :-)
“rules are rules”
Just curious....when the census take comes around....do you simply tell them how many people live in the house them them tell them to get off your property like I do?
or do you follow the “rules” and divulge a bunch of personal metrics that are not required by law?
Cuz the last time....the guy actually made five trips to my house trying to brow beat me into filling out his little list of questions.....he even tried to talk to my minor children more then once to fish information from them....they knew better and got me each time...
?
The last trip he threatened to call the county sheriff.....(which I had already been anticipating)...so I hit speed dial on my phone to the deputy at the dispatch desk (non emergency) I had previously talked to about the harassment from the census taker and handed the census taker the phone and said..”here the sheriff is on the phone”...
The census taker got beat red when the deputy instructed him to leave my property or he would be forced to complete a report for trespassing and harassment as I had already provided the information that was required by law.
He cussed me out all the way to his car...and I never saw him again...
A rule is valid if there is a logical reason behind it....could have...might....if...are not valid reasons
“Cuz I said so” is not a valid reason...
People come up with stupid rules all the time....and other people will follow them...
Just like the recent BS about an apt housing unit trying to ban residents from owning firearms...
I own rental property...and I know for a fact that I cant simply change “rules” on a whim and make my rental non smoking...
I’m bound by past practice and the original terms of the lease (besides the fact I wouldn’t do so)..
Sheep.

Don’t like smoking. Think he should be able to smoke as he damn well pleases in his own house.
Now he has to fight the anti-smoking Nazis.
Thank you for your service and sacrifices Mr. Nowicki.
“As it is they wont get single file when a car is coming
they meander around in packs with their behinds stuck in the air
idiots”
I hear ya. . .those self-centered “Prius”-type elitists of the bicycle world are a real pain.
Road construction on a local street, no shoulder, two-way, the butt-in-the-air spandex-wearing, goofy-looking bicyclists ride two abreast in their pack, backing up traffic with no concern about anyone else on the road.
Try to get close to pass and they scowl at you and move over further to the middle of the road.
These bicyclist road-hogs could take other roads (they don’t live there, just bicycle through) but no, they have to clog up the roads.
http://www.freerepublic.com/focus/f-news/2436331/posts My personal experience with the “long form.”
Regarding what is “required by law,” this poster speaks (erroneously) to that: http://www.freerepublic.com/focus/f-news/2436331/posts?page=87#87
You are technically required to answer but no one has been prosecuted for refusing to answer: http://www.freerepublic.com/focus/f-news/2436331/posts?page=106#106
“3) Do I have to answer the ACS questions? Yes. Response to this survey is required by law (Section 221 of Title 13). Respondents are required to answer all questions on the ACS to the best of their ability. Your answers are very important because they represent the answers of many other similar households in your community. The data that you and others provide in response to this survey are required to manage or evaluate federal and state government programs. If you submit an incomplete form or provide data that are unclear, the Census Bureau may contact you by phone or in person to obtain or clarify the missing information.
10) What are the penalties if I do not respond to the survey? Both Title 13 and Title 18, United States Code, provide for monetary penalties for failure to respond. Title 18, U.S.C., Section 3551, et seq., the Sentencing Reform Act of 1984, establishes uniform penalties for all federal crimes. Title 13 U.S.C., Section 221, makes it a misdemeanor to refuse or willfully neglect to complete the questionnaire or answer questions posed by census takers and imposes a fine of not more than $100. This fine is changed by the Sentencing Reform Act of 1984 from $100 to not more than $5,000. The Census Bureau is not a prosecuting agency. Failure to provide information is not likely to result in a fine. The Census Bureau staff work to achieve cooperation and high response rates by helping the public understand that responding to the ACS is a matter of civic responsibility, and prefers to encourage participation in this manner rather than prosecution.
Unfortunately for us, the wording of the Constitution does seem to indicate that we are subject to all of the questions, since it says The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.
So, the Constitution says Congress makes the law, and the law says we must answer or else... Of course, those of us who believe in a Free Republic are likely to determine that they can take their law and stuff it :-) “
I am a former smoker, I know how enjoyable it is
I also know I had burned holes in clothes furniture my car and walked away from a lit one.
Now I don’t miss it, but I do remember.........
Our comments are the only sane words on this thread.
“Second hand smoke and noxious, offensive odor.”
As are sweaty unclean bodies, smelly restrooms, ghastly cooking odors, heavily perfumed and cologned people and farts.
Yep. At least for the government building I work in...
Perhaps candles should also be banned in America?
well if I was the manager of an old folks home.........still candles are a little different
While I did once investigate for a report of survey a soldier who had burned down his quarters by going out without putting out his candle, a candle user doesn’t usually light candle after candle, wave it around, flick it, sit with it it his hand, etc.
but yeah, in dorms candles are usually not allowed, and when my child went to KU he couldn’t have a coffee pot. Or an iron.
