Chin: Ted Cruz can be president, probably

The Constitution says that only "natural born citizens" are eligible to be president. Is Sen. Ted Cruz of Texas eligible, given that he was born in Canada of a U.S. citizen mother and a Cuban immigrant father?

If Cruz runs, 2016 will be the third consecutive election in which there were questions about the right of a major party candidate to serve. Unfortunately, the Framers left few clues about exactly what a "natural born citizen" is; Congress has not used the phrase in citizenship statutes since 1790.

He is NOT naturalized. The 1952 provision (b) did not apply to him. 301(7) applied to him. Mother a citizen, father not, and mother had all the residency requirements met.

Cruz was BORN a citizen. He was NOT naturalized.

Trust me, someone would come forward with naturalization papers if he had been.

I have cited specific law and provided a link to the Statutes at Large where you can read it.

The fact that natural borns need no action taken by Man to make them such really isn't that hard of a concept to understand.

Unless one thinks that all 'law' is whatever government says it is.

Cruz needs to run for an office where he can make a difference and fight the fedgov...

Cruz needs to be the Governor of Texas...

We are not going to “reform” the fedgov. Its a socialist construct now. The only thing we can do is fight it and kill it. The only weapons that we can do this with are the states. We need people like Cruz wielding those weapons.

So, the fact that Congress shows that they have the authority to decide who is a born citizen says that all subsequent law through the years is not some violation of the Constitution.

The 1795 Act is a naturalization statute.

Here let me help you: The 1795 Act is a NATURALIZATION STATUTE.

And within that statute on naturalization it spells out who is a citizen by birth, so that there is no confusion.

Someone who is BORN a US citizen has no need of naturalization. Is there something tough about that concept?

Cruz does NOT have naturalization papers. Why?

Because he was NOT naturalized. Because he was BORN a US citizen.

Show me a copy of his papers or where ANYONE says he has naturalization papers OR concede.

The law at the time of his birth is what applies. The relevant law in December 1970 is Pub. L. 82-414 § 301(a)(7). Pub. L. 82-414 was enacted in 1952.

And by the law of any year, including 1970, Cruz was born a US citizen.

Show me his naturalization papers. Put up.

To decide who needs to be naturalized, you need to know who doesn't. So, that was a "necessary and proper" law, as empowered by the US Constitution.

No, they were to make a rule, not implement a rule or decide who did or did not fit that Rule....just MAKE the Rule.

Even the Founders didn't try that. They KNEW it was up to them to MAKE the Rule and up to the determination of the People as to whether or not to avail themselves of it. They called it their Right of Election.

2. Aliens by election are all such natural born, or naturalized subjects of the crown of Great-Britain, as were born, or naturalized before the fourth day of July, 1776, and have not since become actual citizens of the United States;

They did NOT run around like the big, blue genie from Aladdin pointing at people and going "POOF!" You're a citizen. Now "POOF!" You're a citizen.

What if that person did not WANT themselves (or their children) to be a citizen?

There are two kinds of citizens, those who are born citizens and those who need to be naturalized.

Since I like to deal in in facts, I'll agree...provisionally.

There are 2 kinds of citizens, yes. Those made by the Laws of Nature (natural born) and those made by the laws of Man (naturalized)

And the law of 1790 PROVES that Congress, the same guys who 3 years before wrote the Constitution, thought it was in their purview to determine who is automatically a citizen. It was signed by then president, George Washington.

AT THAT TIME, yes. Why? Because they had EARNED it.

IF the Founders had wanted that provision to continue to be operational, they would not have repealed it just 5 years later.

If you believe that to be the case, there should be a plethora of evidence to support your conclusion, so please provide it.

A person born abroad who has derived U.S. citizenship through their parents does not require a Certificate of Naturalization. If proof of citizenship is required a Certificate of Citizenship can be applied for.

Certificates of Citizenship may be requested by individuals who were born abroad but are U.S. citizens at birth through their parents, or who became citizens after birth but before the age of 18. A parent or guardian may also request a Certificate of Citizenship on behalf of a minor child.

Certificates of Citizenship are not issued for persons who became a U.S. citizen based on birth in the United States.

What part of “discuss the issues all you want but don’t make it personal” do you folks not understand? Are you so ill equipped to dispute with facts that you have to resort to name calling? I view your responses as childish at best and regardless of which side is correct the language and childish name calling reflects on the name caller.

Barry Goldwater ran for President in 1964. He was born in the Territory of Arizona. By the logic of all these people he would not be a Natural Born Citizen because he didn't technically become a Citizen until Arizona became a State.

What fools these mortals be.

The fact of the matter is that this is really a dead issue. The unchallenged election of Obama clearly shows that there will never be a challenge to Ted Cruz’s eligibility on the Natural Born Citizen issue because no one will go through the process.

Obama has never proven that he was born in the United States, and pursuant to the laws in effect in 1961 he would not have been a citizen had he been born abroad. Regardless it is noted that every single branch of government has certified him as eligible to be president including:

1) The individual voters who chose him to be president
2) The Electoral college which elected him and certified him.
3) Congress by certifying the election results.
4) Every single court that has been presented with this case.

So if Hussein Obama can be certified by all these entities, then Ted Cruz will cruise through the process (pun intended).

This is a circus issue. I believe the people on these threads who are trying to make it an issue are either idiots or Paul Bots.

Obama is not going to be removed from office because he was not a Natural Born Citizen and certainly Ted Cruz is not going to be ruled ineligible. The main reason is that in accordance with all the laws and established precedents, Ted Cruz is factually a Natural Born Citizen.

I don’t recall “demanding” anything. In this particular case you were shown the error of thinking the quote was from someone other than what he was referencing which made you in error. Especially in your vitriolic response. I was simply interested in the voracity of your claims that someone should stand behind what they say or admit they, in that instance were in error.
