And if you decide to get out of line and turn around to avoid the checkpoint, it is all they need to chase you down and use deadly force ...

You’re about as “conservative” as they come? Yes, you are a conservative exactly the same way that a person who empties a can of beans into a pot, heats it up an serves it, is a “cook” — so profoundly mistaken in fundamental principle as to be a fraud.

I see that you are a Viet Nam veteran. Thank you for your service.

Are you telling me that I’m not a conservative?

I'm telling you that DWI checkpoints are an intrusive, unconstitutional overreach of police power, designed to find a crime (any crime) without probable cause. I'm telling you that your apparent support of that overreach is not a conservative principal.

From your own profile page on this site:

A nation of well-informed men who have been taught to know and prize the rights which God has given them cannot be enslaved. It is in the region of ignorance that tyranny begins.   ~Benjamin Franklin

I am late to this thread but I will add my opinion of check points anyway: They are an abomination on the theory we have a fourth amendment. I despise the notion the police can stop you for no reason in the name of anything.

Authorities point to some study which says so high a percentage of individuals involved in accidents were impared by alcohol. First off, what percentage of the population uses alcohol in the first place. So, someone having a beer and driving is more dangerous than someone texting or primping their hair? I doubt it. It is a money maker first of all just like with those equally ridicules speed cameras and stop light cameras. After that, it is a way for the coppers to show some results for their enormous budgets. lastly, it is a way to tame the population.

wow. even worse than I thought. You actually think it is ok and admirable that the cops "let" you go after you were stopped without probable cause? Please see your rights are being trampled. I understand you believe they are good, honest people just trying to help...but that doesn't make it right. It is still a violation of your rights! If you choose to pull over and talk to a cop on your own, tell him what you drank and when, etc., then go for it. Otherwise, Please read this:

Amendment IV The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

DUI checkpoints in Texas are non existent. Outlawed as unconstitutional about 25 years ago.

Yes, Easty, but now we have "no refusal" weekends.

I had a co-worker get caught in one of those and it was Tuesday night before she was out of jail.

Yeah what's up with that? We came into NM from AZ at Silver City, then through Deming over to I-25, then up and over toward White Sands, and way up there, there was a permanent ICE checkpoint with the scales and scanners and cameras, all of that. Why not just SECURE THE BORDER?

I have been through only one state checkpoint in NM, supposedly to check for tags on killed game during hunting season. What is the connection to "public safety" in that, anyone?

I realize the CATO institute is a libertarian institute, but they document abuses by law enforcement and other officials.......talk about scary.

Reading some of the accounts and it will send chills up your spine. Innocent folks being roughed up, homes invaded, trumped up charges, mistaken identities.

More common than folks really realize.

5. Too many laws.

In the name of “the rule of law” we've allowed gubbamint to pass laws on top of laws on top of laws that govern every move you make.

Common sense has been replaced with the watchful eye of big broth-ah gubbamint.

I read an article that described how folks unwittingly violate the law every single day of their lives and don't even realize it. In fact, the article goes on to say that many folks commit up to three felonies a day without knowledge of it.

The example given...Have you ever thrown away junk mail in your box that was addressed to another person? It is a felony punishable up to five years in jail.

No kidding...wow! He’z right. We have too damn many laws. Bad news...it ain't gonna get any better. Good news...move out to the country where your chance encounter with LE are much smaller.

I am in no way defending their actions as a whole. As stated in the original post - the artificial ‘hit’ they generated with the drug sniffing (supposedly) dog was basically planting evidence to justify further searching. That was wrong. It should be investigated. And likely some sort of disciplinary action applied. Because that was, without any doubt, over the line.

I do not question the officers for getting tough when he refused to roll his window down. That was act of hiding or deception given it was a simple request - and a likely legitimate one from a pure communications aspect. The officer should have said ‘Its noisy out here, please roll down your window some more.’. Keeping the window up or most of the way up shows a possible intent to hide the smell of alcohol or other substances. The driver intentionally created the appearance of deceit or hiding to trigger the extended detainment. When you go through a ‘DUI checkpoint’ the officers want to stick their nose in your car, smell if your stinking drunk or if you have a 12-pack of empty cans on the floor. If you will not roll down your window it looks like you are hiding these two elements. That is what he did and that is why he got the extra treatment - and he knew it. He had been through these checkpoints before and know they just want to observe for the obvious elements of DUI.

If the driver is correct about them causing the dog to generate a ‘fake hit’ that is bad.

I also find the officers overall reaction to the discovery of the video interesting. They clearly did not destroy it and did did not seem alarmed by what it might have caught.

I have been the ‘victim’ of an over aggressive police detainment. waiting for over an hour for a breathalyzer/paddy-wagon to show up. When it did, the results were an embarrassment to the officers on-scene and the situation quickly resolved.

These were local deputies on a big summer drinking holiday in mostly rural Tennessee where people will party hard doing what they do. They possibly crossed a line if they did generate a ‘fake hit’ with the dog and there is no excuse for that and that should be investigated.

Now if we start getting Federal DHS officers doing this on any old day at any time in the name of public safety or stopping terrorists....that is a very, very different story.

“Cops think they are entitled to manufacture probable cause. They are not.”

I am not defending this. In fact, I think it IS a serious problem shown in this video.

he got away with that sh!t for one reason and one reason only

it was an organized check point with other leo's and witnesses there... if it was just him and that first cop along the side of the road and he tried it, he'd be just another dead white boy...

I'm a little late to this thread but have a question for our FReeper LEOs...

We were driving home from our home fellowship group (home church group) late on a Saturday night and encountered a County Sheriff's Department check point not far from home.

The deputy asked "Where have you been tonight?"

EVERYTHING inside of me wanted to respectfully respond with..."Sir we are in America and that is not a question I need to answer unless you have probable cause that I have committed a crime". However, since we were tired and did not want to spend the next few hours extricating ourselves from stupidity, I responded with the truthful home fellowship group answer.

He grunted something and told us to go on.

What could I have said differently that would not have generated a multi-hour delay in our arrival home?

“Some of the videos I saw from the Boston lockdown were frightful. But they got by with it, didn’t they?”

Of course they did. And with plenty of support from “conservatives” right here.

“I am not defending this. In fact, I think it IS a serious problem shown in this video.”

The problem, as I see it, is many believe this kind of abuse is something unusual. It is not. It is standard operating procedure. And the “problem” didn’t start with him not rolling down his window. His window was already down. The problem started when the Jack Booted Thugs set up the roadblock.

They built a permanent one up there???!!! I haven’t been through that area in a few years, but it wasn’t there before. Oh my....

The Stasi is allowed to detain and/or interrogate us within 100 miles of the border. The Das Fuhrer “Homeland” agency started this. Here’s just one link (with an old petition): http://forcechange.com/62464/stop-unconstitutional-searches-and-seizures-within-100-miles-of-u-s-borders/

I’m not currently a LEO, hope you don’t mind my commentary and lack of answers ... And this is on the Border Patrol, not urban police...

I have heard stories (tea party speakers) of people pulling out the Constitution or nicely declining. One young preacher down here was pulled out of his car and got a face full of glass.

When I went through the various checkpoints, I was very respectful and polite. However, later, I was told that after they ask you, “Are you a U.S. citizen?” you don’t have to answer anything else. The problem was — in our case — they asked 4-5 other questions first! And, even if they did ask that question first, and continued on, I’m not brave enough to politely say anything else...

....lastly, it is a way to tame the population.

I think that's the heart of it. DHS has the airports and now a lot of subways, stadiums, bus stations, so on under lockdown.

They have two-thirds of the US population contained under the 100-mile border rule (north and south). They have ag and DUI checkpoints under state and local options. They have paramilitarized local police depts, driving the type of vehicles that should send chills through any real American.

The naive do-gooders who have drinking problems in their local areas have no idea what is coming. Just like microchipping the wildlife lead to domestic pets, Alzheimer's patients, prisoners, now babies -- and eventually everyone who submits (or maybe doesn't), the DUI checkpoints are just further training to get people to line up for their train rides.
