WASHINGTON The U.S. Naval Academy is investigating allegations that three members of its football team sexually assaulted a female midshipman at an off-campus house last year, a Pentagon spokesman said Friday, and a lawyer for the woman says she was "ostracized" on campus after she reported it.
The names of the players were not made public and the athletic director deferred comment to a Naval Academy spokesman, who said school leadership were monitoring the investigation but declined further comment.
The allegation is the latest in a string of sexual assault cases that has drawn attention in Congress and at the highest levels of the Pentagon. Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, and the chiefs of each military branch, are scheduled to testify next week at a Senate hearing.
The alleged assault occurred in April 2012 at an off-campus house in Annapolis. The woman woke up after a night of heavy drinking and later learned from friends and social media that three football players claimed to have had sex with her while she was intoxicated, her attorney Susan Burke said in a statement Friday. She said her client reported the allegations to Navy criminal investigators, but was disciplined instead for drinking. The athletes were permitted to continue playing.

So she got so drunk she can’t remember having sex. But the equally drunk men are expected to have complete self control. Here’s a tip don’t get so F###ing drunk you can’t remember if you said no or not.
That’s right. Gotta keep some perspective.
“Contributory negligence in common-law jurisdictions is defense to a claim based on negligence, an action in tort. It applies to cases where plaintiffs/claimants have, through their own negligence, contributed to the harm they suffered. For example, a pedestrian crosses a road negligently and is hit by a driver who was driving negligently. Since the pedestrian has contributed to the accident, they cannot sue the driver for damages because the accident would not have occurred if it weren’t for the pedestrian’s own negligence.” [wikipedia]
Why do headline writers insist on using the words “probing” and “sexual assault” in the same title?
I don’t think contributory negligence is applicable in a criminal sexual assault case. Getting drunk and passing out is not an invitation to rape.
From the excerpt, though, it’s not clear that an assault even occurred. Some guys said the next day that they had their way with her — well, some guys will do that. It’s not very honorable to sully a woman’s reputation (if it wasn’t already tarnished), but that doesn’t meant they’re guilty of a crime.
Women and Homosexuals have no business in our military academies.
All of their parents must be so proud.
It takes a heckuva lot of tax payer money to educate these young adults (NOT kids).
Then they go and get drunk and rape or get raped.
Dumb &*(*&!
I have heard from some I consider to be reliable sources that sexual assault is a problem at the Academy. The only women who feel safe are those whose fathers (or mothers) are at least Rear Admiral or above.
Not in the military. A woman so much as walks past the beer section of a grocery store and later has sex........well, he took advantage of her.
If there's alcohol involved a guy might as well say, "here take my money and trash my career."
I saw one instance many years ago where some female was bragging about her "skills" prior to drinking and prior to being released for the weekend. Over the weekend she demonstrated those skills to a few guys. Come Monday morning she felt that she had to do it in order to belong and prove herself and wanted her good name back. Yeah, the males (four total IIRC; one was a buddy) all went up to see the man and the holy fear was put in everyone the consequences not yet dreamed of if you were caught spreading rumors whether true or not. Wonderful way for them to start their military career.
That's why I loved the infantry so much; less chance of that happening.
What's good for the goose (is good for the gander). Something that you say to suggest that if a particular type of behaviour is acceptable for one person, it should also be acceptable for another person.
From a couple recent Courts Martials in the past year - it's not uncommon. One gal came out of a blackout while "involved" and freaked. If there hadn't been witnesses and a documented past of such behavior, the poor schlubb she accused might have been convicted. Another was into frequent threesomes with a few guys and one day decided to call it rape and forceful sodomy - guy got off on that charge but the drugs still cooked his goose.
