It says the younger girl’s parents called the authorities after the older girl turned 18. My question would be, did the sexual activity continue after the girl turned 18? It would make a big difference if the defense can prove everything happened when both girls were minors.
In Florida law (re: lewd and lascivious battery), consent is a ‘prohibited defense’...

Society and the laws have made it difficult to illegal for a parent to control their children’s behavior.
Just as an aside, dating isn’t against the law. In this case the older girl is charged with having had sex with the younger girl.

I personally think that the parents of the 15 year old should have just pulled her out of the public school as soon as they learned of her relationship with the other girl and homeschooled her.
Notice that this is being addressed on an age related basis though. And that is not really addressing the problem here IMO. And I think you agree with that.
Yes and they were dating. It wasn’t just having sex I don’t believe, although that actually does happen when teenagers date.

Yes, lot’s of time that happens. Some young girl wants to be with an older boy. Could have been the same kind of situation here.

They probably went ballistic when they learned they were having sex. (I know I would have...though I don't know if I would have called the police).
The age of consent is 16 in most states.
As a basic rule...Anyone over 16 that boinks anyone under 16 will get charged with a crime.
States vary but 16 is key in most states.
As I pointed out in another thread yesterday, there are many laws that define whether or not something is legal by age. For example, if the girl in question attempted to vote one day before her 18th birthday, it would be illegal; one day after, legal. If she tried to buy alcohol one day before her 21st birthday, illegal; one day after, legal. If she signed a contract one day before her 18th birthday, it would not be binding upon her; one day after, it would. An so on and so forth.
So are you arguing that ALL age-based laws should be repealed? And if not, why should this age-based law be any different than any other?
