Updating our earlier report:

Details are emerging that when U.S. Magistrate Judge Marianne Bowler read Dhokhar Tsarnaev his Miranda rights, she went to his hospital room accompanied by a federal public defender (meaning taxpayer-funded) and an assistant U.S. attorney from the Massachusetts prosecutor’s office.

Reports say the FBI was only partway through questioning Tsarnaev to get intelligence to determine who else was involved in the plot and how broad it was. The FBI told federal lawmakers in classified briefings this week they were “stunned” when this judicial officer and lawyers from both sides showed up to read him his rights. Tsarnaev was providing what the FBI called valuable intelligence, when he was read his rights and then immediately stopped talking.

As we’ve explained before, the only danger with denying someone Miranda rights is that whenever the Constitution would require those rights to be announced, anything the defendant says after that point cannot be used to convict him in court. When the public-safety exception to Miranda applies—as it does here—police generally have about 48 hours of questioning the suspect before a judge would say the agents have had enough time to deal with imminent threats and therefore must now administer Miranda. The FBI was only 16 hours into those 48 hours when Miranda was given.....

If these bombings had happened under a Republican administration, the Democrats and press would have been demanding the resignation of the both the Secretary of Homeland Security and the Director of the FBI for incompetence the minute the news came out about Russian warning the US about the brother and the FBI having interviewed him. Pelosi and Reid would be conducting hearings and press conferences daily.

Boehner is preoccupied with the bottle he keeps in his drawer, and McConnell is too busy duct-taping the Basset hound folds of his face so they don't droop onto his desk.

My understanding is when a criminal complaint is filed against a suspect, THEN THE LAW REQUIRES A JUDGE TO IMMEDIATELY MIRANDIZE the suspect.

The actions of CZAR B.O. and his capo, the ATTORNEY GENERAL, were as predictable as the movement of the hands on a clock. They wanted the suspect to shut up and the best way to do this was to charge him with a criminal complaint!

The FBI is not a stand-alone agency. The DOJ has oversight of the FBI, always has. And, as has always been, the DOJ can shut down any FBI investigation.

I wonder if the magistrate and the Just-us official were ALONE with Dhokhar Tsarnaev when they “read” him his Miranda rights.
I also wonder what else they “read” him. I suspect it was something along the lines of:

“Shut the hell up and we will take care of this. Your survival depends on you doing as we tell you.”

I’m no fan of Holder’s Justice Department, but it’s kind of silly to suggest that anyone “undercut” the FBI when that agency had demonstrated such rank incompetence with these particular individuals in the past. I have no evidence to suggest that the FBI would have been any more successful in questioning the younger mutant than they had been when dealing with the older one a couple of years ago.
