Regular viewers of Fox News are used to seeing popular host Megyn Kelly on their televisions every afternoon, but on Thursday morning Kelly made a special appearance during the morning to break some surprising information: according to her sources, the FBI was shocked to see a magistrate waltz into the hospital room of Dzhokhar Tsarnaev and read him his Miranda rights.
So why were they shocked? According to Kelly, the FBI was under the understanding that they would get much more time with Tsarnaev under the public safety exemption before he was read his rights. Adding to the shock: the sources told Kelly agents were getting crucial information after only 16 hours of questioning and were making valuable progress.
No matter.
Its really unbelievable, Kelly said.
The FBI had no idea they were sending over the judge, the prosecutor, the federal public defender; and the FBI said they were only 16 hours into what they understood would be a 48 hour period of questioning
. They said they were in the process of getting valuable information
and as soon as that magistrate judge went in there and gave him his rights with his lawyer present, he stopped talking. They said they would never have stopped interrogating him prior to the 48 hours unless they were forced to.

I call bull, the FBI would have never even let him through the Hospital door unless they had been ordered to from higher up and for that matter Judges don't "waltz" in of their own accord, they are directed to by somebody in the Department of Justice.
I’m still pissed at MK for her little performance on needlessly grilling Bob Beckel on his comments from “The Five” the day before. I think she went overboard in a ‘bend-over-backwards’ hit job on him about the position (a logical conservative position on halting immigration for a while) he took. It smacked of smarmy ‘getbackatthemism’ if you ask me.
On this? They were flabbergasted a judge came in and read their perp his rights guaranteed to him (liberals fought for this hard, BTW)?
Well, it doesn’t surprise me. I don’t recall hearing of any Miranda Rights during Ruby Ridge or Waco, either...par for the FBI course - when you’re a right wing enemy.

Why would they be shocked. A dead Ambassador and Seals didn’t stand in their way so a dead 8 year old won’t matter either.

What do you want to bet that the federal Public Defender and that Liberal Judge are old “buddies” and the Public Defender asked the Judge to accompany her and read the Miranda Rights without any authorization from the Justice Department. I am surprised the FBI let her in the room without first getting clearance from someone higher up in Justice.

Did everyone not see this coming? Of course he is silent now when his rights were read he was given an attorney who told him to be quiet. Plain and Simple.
This is why I agree that he should be tried as an enemy combatant. One I do not believe he is a true American Citizen being he took his Oath of Allegiance 7 months ago on 9/11/2012 where it should be quiet obvious to prove he lied during that Oath and took it under false pretenses. Why should Dzhokhar be treated like an American when he obviously never had intentions to be an American.
Who knows how this sort of thing actually works legally? Can a president or governor instruct a judge or magistrate to go and read someone their Miranda rights? What about separatin of powers?
Or did someone from the Justice Dept. or other federal or state agency have to file something with a court and then get the courts approval and participation?
And when this was done, didn’t they have to overrule the federal (?) prosecutor who’d decided to invoke the public safety exemption?
I think I heard Glenn say this guy, as an American citizen, should have his Miranda rights read. It was either on yesterday's or Tuesday's radio show.
Alan Dershowitz also thinks he should be Mirandized (?)...here's what he said, FWIW:
Dershowitz insisted that authorities would come to regret not reading Tsarnaev his Miranda rights, partly because there was never any basis for the public safety exception, but, more significantly, because they may have blown their chances of getting a death penalty conviction. Why? Because theyll need to be terrorist intentions, but the information they get may not be admissible in court.
So, is the FBI shocked because he was warned, or how the judge went about it? Any legal eagles out there care to chime in?
The FBI is just as complicit as Obama, and fawns over his illegal acts, destruction of the Constitution, treason and sabotage. And, they still can't find any records on him until he showed up in Chicago politics.
So now when they can't figure out fast and furious or whether a Chechen immigrant running from Putin is a terrorist or not, they can express Selective Astonishment, and it's all good.
Nobody simply “waltzes” into a room guarded by the FBI any easier than any of us could simply “waltze” into the White House unannounced. Higher powers permitted this.
That terrorist should have been shot in the boat; he will never be executed for mass murder.
