Several Republican lawmakers are calling for the surviving suspect in the Boston Marathon bombings to be tried as an enemy combatant, rather than as an ordinary criminal.
It is clear the events we have seen over the past few days in Boston were an attempt to kill American citizens and terrorize a major American city, read a Saturday statement from Sens. Lindsey Graham (R-S.C.), John McCain (R-Ariz.), Kelly Ayotte (R-N.H.) and Rep. Peter King (R-N.Y.). The accused perpetrators of these acts were not common criminals attempting to profit from a criminal enterprise, but terrorists trying to injure, maim, and kill innocent Americans. The suspect, based upon his actions, clearly is a good candidate for enemy combatant status. We do not want this suspect to remain silent.
Their statement came after Dzhokar Tsarnaev was taken into custody and sent to the hospital Friday night.

I’m here trying to make the argument that we as conservatives should fight back and take those powers back.
I’m under no illusion that this will make me unpopular here. I’m new and so far haven’t had a hard time but because I’m strict about the Constitution which I believe to be an amazing document then it forces me to take unpopular positions.

They constituted the Federal government and have a lot of power. All those MA laws are constitutional.
Under your interpretation then the States can ban the 2nd Amendment And the First and so on.
But what the tenth actually sez is "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
So all those laws in MA concerning owning guns and restricting their use are unconstitutional as well. Like I said you know two things about this situation. "Jack" and "Shit"...
The states can't amend or transgress against the 2nd Amendment nor can the FedGov. But they both have done so. but your argument states the FedGov Can't and the States can.
Like I said Bottom Line: the Way the law stands now the Feds have jurisdiction and can charge him and so can the State and you haven't a clue about which you speak.

I agree with you: I’m against all State laws to restrict ANY part of the Bill of Rights. As for the 2nd i’m against background checks and everything else. These are God given rights which no one can take away or restrict although that doesn’t stop them trying.
Graham is trying to polish up his credentials as a so-called conservative. Don’t believe him. There’s a campaign against Graham going on in SC. The people there have this snake on the ropes, with his approval rating falling from 71% to 54%.

The trial will be a charade because it cannot examine and has no authority to act on the international and US security concerns. Having it even nullifies them. So why have a charade, unless that’s how you make your living.
The leeway accorded to enemy combatants would be to send him to Gitmo and get information out of him by whatever means necessary. Mincing lawyers are not going to provide the information about the threat this bomber and his contacts pose.
How do you get “he is clearly not a combatant”? From his recent and clearly false oath? Your geography reference makes no sense. He attacked in Massachusetts. The 9/11 terrorists attacked in New York and DC. So what? Terrorism has come to America. Are these criminal killings by Americans or attacks directed from forces outside the US?
Perhaps unfortunately we are beyond the days of uniforms and soldiers standing in neat little rows firing volleys at each other en-mass. We are fighting forces outside the US that are international in international Islam. It is many countries and no single country. They seem to want to kill us, so we have sent US soldiers to Iraq, Afghanastan and other places to fight them even though they don’t wear uniforms or have a single flag.
You can play “Law and Order” with this one if you want to. I am not interested. Trying to extend Constitutional Law into the battlefield is a fools excercise, even when that battlefield is on our own soil. Perhaps especially then, since it means that we are losing, and idiotic policies like this are probably behind it.
