The family of a shoplifter who was shot and killed last December by an off-duty Harris County sheriff's deputy has filed a wrongful death lawsuit against Wal-Mart Stores Inc., the sheriff's deputy and the security company that hired him.

Shelly Marie Frey was killed in the Dec. 6 shooting. The off-duty deputy, Louis Campbell, told investigators he feared for his safety when he shot into a car and struck her, saying the driver tried to run him over.

"Wouldn't that make a lot more sense?"

I see now. Yes it would. My bad.

From the article:

“Tragically, Frey wasn’t even supposed to be at a Walmart that evening.

Earlier in the year she pleaded guilty to stealing shirts and a package of meat from another Walmart and as part of her plea arrangement she agreed to never enter Walmart stores again.”

I can't say if it is still true, but at one time it was Wal-Mart corporate policy to not settle any lawsuit. They always went to court as SOP. Those trying for “go away money” were always disappointed.

Just curious about something here:

There were two children in the car. Were those children left in the car during the shoplifting spree or did they bring them into the store with them???

And when they got in the car to make their getaway, did they risk those kid’s lives by failing to buckle them in before they did make their getaway???

It’s 2013. My apologies to your sensibilities if I used the more modern example.

Don't know. But I do wonder  - while shoplifting at WalMart - if she picked up some eye-brow makeup.

I dunno, the idea that citizens will defend their property seems like a pretty valuable notion to promote.

SQUAT nothing! Loser should PAY! Make it bite when you sue and lose. That would stop a lot of these frivolous lawsuits...

Citizen defending their property is fine. But what corporations have learned is that having employees defend the company’s property always ends badly for the company. If anybody gets hurt (innocent bystanders, the employee, the perp) they’re suing the company, which is why so many companies have a policy of no resistance. We hear the tales all the time of employees getting fired for thwarting thieves, and this case right here is why. WalMart is probably going to lose more money on this case than all theft loses for the month maybe even the quarter, a handful of these cases every year and they go under.
