The family of a shoplifter who was shot and killed last December by an off-duty Harris County sheriff's deputy has filed a wrongful death lawsuit against Wal-Mart Stores Inc., the sheriff's deputy and the security company that hired him.
Shelly Marie Frey was killed in the Dec. 6 shooting. The off-duty deputy, Louis Campbell, told investigators he feared for his safety when he shot into a car and struck her, saying the driver tried to run him over.

I remember that story. Nearly 400 replies. No surprise the family is suing. But - Thank God - this happened in Texas and the shooting was justified.

I saw it coming. They are hoping Walmart will throw some money at them to make it go away. I hope Walmart stands their ground like the deputy did.

What else would you expect him to say? That assertion is the only conceivable basis for the entire lawsuit.

And now we see why so many companies have the “no resistance” policy to theft. Life is a lot easier for them when the criminals get away with it. Nothing this guy was going to steal is as expensive as the out of court settlement will be.
I would expect him to say that HIS CLIENT's actions did not necessitate deadly force.
Wouldn't that make a lot more sense?
I suppose someone might be able to find an honest personal injury/wrongful death lawyer, but probably not in this case. Probably figures W-M will settle out of court to avoid bad publicity.
Anyone know if security camera footage was ever released?

I am sure Herschel P. Cashin (Cashin-n) is a very reputable ambulance chaser. From the site, I see that he only has one Public Reprimand on his record. Hey, for ghetto shysters that is a fabulous record.
