Women shot during LAPD ex-cop manhunt had no warning, lawyer says

A mother and daughter who were mistakenly shot by Los Angeles police hunting for rampage suspect Christopher Dorner had no warning before bullets started whizzing through their newspaper-delivery truck, their lawyer said Friday.

“No command, no instruction, no warning. They just opened fire on them,” said Glen Jonas, who is representing Emma Hernandez, 71, and Margie Carranza, 47, in possible legal action against the LAPD.

“They had no idea what was going on. They’re huddling, covering up and praying and hoping they’re not going to die.”

Both women survived. Hernandez, shot in the back, was in good condition Friday. Her daughter suffered a hand injury during the shooting and is now physically fine, but emotionally scarred, Jonas said.

The LAPD admits the predawn Thursday shooting was a case of mistaken identity that unfolded while police were guarding the Torrance home of someone named in a manifesto that ex-cop Dorner posted online about his twisted plans to avenge his firing.

Chief Charlie Beck said the officers saw a vehicle that matched the description of Dorner’s, driving through the dark streets with no headlights – and a “police-involved shooting” ensued.

Jonas said the women’s blue Toyota Tacoma looked nothing like Dorner’s dark-gray Nissan Titan, but that even if it had been a match, the police should not have fired on it.

“They still have to give the guy an opportunity to surrender. You can’t just execute him,” the lawyer said. “It’s in these high-stress situations where you follow your training and they violated every piece of training they ever received.”

The LAPD had no comment on Jonas’ claims.

He said he expects the city will offer his clients a substantial payout; if not, he plans to file a federal civil rights lawsuit.

“Thank God they didn’t die. It’s a miracle they didn’t,” he said. “If it was a movie, you wouldn’t believe it.”

From what I’ve been reading here and there, cops in SoCal are scared sh*tless right now. They have a very real concern that this guy could be anywhere, even quite possibly back in L.A. proper, waiting to go sniper on any cop who has the great misfortune to run into his sights.

If this guy stays at large for a few more days, bides his time and then starts picking off the occasional random cop on patrol in different parts of the city and its environs, the cops are going to get even jumpier then they are right now.

A quick glance indicates about 40 rounds fired.

Just out of curiosity was one of them carrying an "assault rifle", did they reload twice or are they issued handguns with drum magazines?

I dislike lawyers and lawsuits...yet in this case had that been me in that truck....I would have one by now.

If I'm driving my truck, at night and somebody opens up on me with no warning, I will return fire, if floor boarding it to escape is not an option.
Otherwise it's pointless for me to carry.
You probably got a second to make that decision or die.

Hate to say it, but this disgraceful near double-murder backs up some of the more disturbing accusations made in Dorner’s “manifesto”. The LAPD is a pathetic mess.

I there were 2 cops, shooting 40 or 50 rounds from a handgun would have been about 2 magazines each.

Fox had a shrink on analyzing Dorner. He’ in her view, a true narcissist. He description made him sound creepily like Obama. Over inflated ego, sense of being wronged in his life over and over, desire to get revenge in great excess of any wrong done to him. I read the manifesto and this analysis seems spot on, and murderer that he is, he writes well.

These two cops shot over 40 rounds at two unarmed innocent bystanders and they didn’t put either of them down.

If they had been real criminals and the cops had run out of ammunition because their clips or magazines were limited to 7 bullets each, it is likely they would not have been able to hit either of them even once.

Of the 40 bullets fired by these “well trained and displined” Soon-to-be-ex-Officers, only 2 hit their mark.

What if some untrained and undisciplined home owner had to face down a couple of home invaders and only had 7 rounds to take them both down?

If two cops can’t put down two newspaper delivery ladies with less than 40 rounds, how could anyone expect a home owner to take down a couple of armed and dangerous home invaders with only 7?

Taking into account cop accuracy, there may have been another 50 that missed the truck completely.

Aren’t police issued special 17 or 19 round magazines ?

Possible scenario:Three cops shoot until their guns stop going bang.Gotta allow some complete misses on a target as small as a pickup truck!!!

In a just world,all those idiots would lose forever any law enforcement or firearms licenses,be personally bankrupted,and spend significant time at hard labor.

But in a just nation Lee Horichu? would have been punished for the murder of the woman at Ruby Ridge and Janet Reno and the ATF would have been arrested for conspiracy just for planning the Waco massacre.

I despise bad cops even more than I despise the drug thugs,because the bad cops are only pretending to be the good guys.
