New York's 'SAFE' Act: The 'Rape' of the Second Amendment
American Thinker ^ | February 5, 2013 | Michael Filozof

Posted on 02/05/2013 12:40:17 AM PST by neverdem

In January, the New York State Legislature passed the Orwellian-sounding "SAFE" (Secure Ammunition and Firearms Enforcement) Act. The act was debated in closed session without committee hearings, and Gov. Andrew Cuomo signed it into law within an hour of its passage -- after waiving the required three-day public comment period. Cuomo bragged that New York now has the "toughest assault weapons ban" in the country but claimed that the law respects the Second Amendment and preserves the rights of "hunters and sportsmen." The former is true; the latter is a bald-faced lie. Even if you do not live in New York, you should be very worried, because the SAFE Act is a harbinger of what Democrats in the federal government will do nationwide if they can.

The SAFE Act is far worse than you might imagine. Harold "Budd" Schroeder, member of the NRA Board of Directors from New York, described the law as "the rape of our gun rights." That is no exaggeration. The law is as harsh as (or harsher than) the gun laws of some European nations that do not have a Bill or Rights or a Second Amendment.

The most widely reported provision of the law is the total ban on the sale of military-style rifles classified as "assault weapons," effective Jan. 15. The provision forever prohibits anyone other than a law enforcement agency from acquiring such weapons, including the popular hunting and target variants of the AR-15 rifle. Current owners of such rifles must register them with the state by 2014, and the registration must be renewed every five years. This gives the state a list of persons from which to confiscate them in the future, and the five-year renewal provision gives the state an excuse to find ways to deny ownership once every five years....

Bloomberg/Cuomo making criminals out of law abiding citizens, right and left through Slurpee Big Gulps, smoking, eating, and now guns and magazines. Lookout NY’ers, next they’ll be coming after sex.

Hah!

I assure you that guys aren’t paying $2000+ for AR’s & AK’s in NY right now with the intent to register them by next Jan. 15th.

NY may well be “ground-zero” for CW2.

Echos of NYC. GO back to the late '60's. NYC required all owners of AR-15s to register them with the promise that "The registration list will never be used for confiscation." Now jump ahead to the early '90's and David Dinkins. Dinkins and his city council of left wing statists passed a law that all of the registered guns had to be sold, turned in to police, rendered inoperable or confiscated. About 45 people failed to comply. It turned out that most of these were paperwork errors, but about a half a dozen were stormed by police their guns confiscated and they were arrested.

Yet another reason to despise New York.

“Yet another reason to despise New York.”

Yet another reason to despise New York [CITY], not NY in general.

The law affirmatively requires that a person's firearms must be confiscated if any order of protection is filed against him -- no matter how bogus the complaint may be.

This happened to a buddy of mine. I posted this a few weeks ago. He lost his rifles because a crazy woman filed a bogus charge against him. She never showed up to court and he never got his rifles back. This happened over ten years ago.

I had a similar situation 2 years back. Mine went to the pawn shop (out of my legal possession, but still owned by me), and were reclaimed without incident.

Total NY votes for 0bama = 3875826, for Romney = 2226637

NYC votes for 0bama = 1677024 for Romney = 373847 (NYC ratio D:R = 4.48:1 Democrat)

Subtracting NYC votes from total NY state votes 0bama = 2198802 Romney = 1852790 (Still a ratio of 1.186:1 Democrat) New York state without NYC is still majority democrat.

New York [CITY], not NY

A distinction without a difference. Plus the grossly misnamed "SAFE" act passed for the STATE of NY, not just NYC.

Very true. Ammo sales in NY will drop to a trickle, if I lived there I would go out of state to buy it.

“about a half a dozen were stormed by police their guns confiscated and they were arrested”

As I recall, one got a “turn it in or bad things will happen” letter. He replied with a “come get them” letter. They raided the address. He had moved to Montana; the new occupants were not amused.

There is nothing about safety in the Safe Act. This is not only an infringement but outright intimidation of legal and honest gun owners. Obviously designed to make total government control an easy reality.

This is the sort of law that would make any tyrant bust his buttons in pride of ownership!

Man, oh, man, am I glad I moved out of NY - but I still find that cold comfort.

Unfortunately, this is the sort of tyranny awaiting all of us if we lose the fight to maintain our 2nd Amendment rights to these fascists. Once the 2nd Amendment rights go, they all go. We can bet the farm on it!

Perhaps I should be more specific.

We up-staters consider NYC to include the surrounding area, i.e. NY Metro. The population of NYC and the adjacent area is 22 Million people, mostly liberals. Of course, there are pockets of Marxists/Socialists upstate as well, Ithaca, Buffalo, Syracuse, Rochester, etc.

Think Atlanta as opposed to the balance of your state.

“The New York City Metropolitan Area’s population is the United States’ largest, with 18.9 million people distributed over 6,720 square miles (17,400 km2),[29][30] and is also part of the most populous combined statistical area in the United States, containing 22.1 million people as of the 2010 Census.[31]”

Yes, we upstaters are outnumbered, but not by much and that margin is narrowing. So, you might say that we too.... are “occupied”.

A normal thinking adult would show their support for us upstate CONSERVATIVE NY’ers who are battling the strictest anti-gun laws in our country.

You, however, seem to attack us at every opportunity. We are not only fighting for our rights up here, but for your rights as well. You should be praying for your fellow ‘like-minded’ FReedom-loving gun-owners in NY State instead of launching immature attacks on us.
