Obama may Ignore the Debt Ceiling and Suspend the Constitution: Obama and the Debt Ceiling

The debt ceiling is the last leverage that Republicans have to prevent out-of-control Federal spending and on various policy issues. Liberals know this: even as Senate Democrats talk of ending the right of Republicans to filibuster, liberals are seeking to defang the Republican House of Representatives as well. They are also now peddling a new theme that the debt ceiling itself is unconstitutional under Section 4 of the 14th Amendment. Therefore, President Obama may simply ignore the debt ceiling.

The looming debt ceiling fight could allow Republicans to soundly defeat Obama's overspending. In the "fiscal cliff" deal, Republicans succeeded by making most of the temporary Bush tax cuts permanent, but failed to get spending cuts. Yet now, Republicans could use the debt ceiling vote to slash spending. The overall result could be serious deficit reduction at lower permanent tax rates. But this requires Republicans to stand united and refuse to raise the debt ceiling.

Section 4 of the 14th Amendment requires: "The validity of the public debt of the United States, authorized by law... shall not be questioned." Liberals argue that if Congress has authorized spending, this automatically gives the president the power and even the obligation to borrow whatever it takes to spend all the money for which Congress voted. When Congress votes to spend money, this includes the obligation of the chief executive to take whatever actions are necessary to pay the debts of the United States Government. That is because "the validity of the public debt" ... "shall not be questioned." Thus, any debt ceiling law violates Section 4, they argue.

Suddenly the appeal for Washington to abandon the U.S. Constitution from Georgetown Law Professor Louis Michael Seidman in the New York Times makes sense.

Section 5 of the 14th amendment states:
“The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.”
The President is given no authority to over ride the Congress.

I want the states to reform a new constitution, not the jerks in DC

I don't trust them either. Can you imagine the pressures they would be under to ensure loopholes and ambiguity?

I do agree we need to make some tweaks, like term limits and the progressive tax system as well as the other things you mentioned. But we're taking about the major things that give to politicians the power they have over the people. No way they're ever going to give that up in a million years.

The problem is the people who run the system, not the system its self.

I don't have the answer how to fix it other than flushing DC and putting in trustworthy people, and I think we all know what that would take.

Obama can’t ignore the debt ceiling unless Congress lets him. If he tries, the House can simply “zero out” the budgets for every cabinet level department except Defense and let Obama explain to his supporters why their Federal jobs are going away. The Left was deathly afraid Newt Gingrich was going to do this back in early 2005.

USAF, I think you are correct. When theconstitution is suspended, the window opens for all sorts of activities that were considered illegal because of someone’s understanding of the constitution........BATF comes to mind. I will be suspending my aversion to firearms previously considered illegal.

On a side note, some red state folks might start a more perfect union of their own.

I want to buy new furniture for my living room. I only have 50 dollars available credit left on my mastercard cuz I just got done refurnishing the dining room. I’ll just give the bank a call and tell them I want more credit, another $20,000 should do it. And I can take my time paying it all off, cuz when my unemployment checks run out Mr. Obama will extend my unemployment and offer welfare, and when that all runs out I can just file for bankruptcy. Hey, I got a free phone, maybe I can ask for a new car next. Wow, this is so much easier, and more fun, than trying to live within a budget. I run out of money, I can just ask for more! /sarc

In the meantime, the GOP should put out their very best Constitutional experts and explain to the public that zero is assuming unconstitutional and dictatorial powers and that henceforth, any spending or legal actions by the executive have no basis in law, and citizens would be under no legal obligation to follow them.

I agree 100%. Give the Sunday talk shows really something to talk about. Make it a topic the LSM will have to discuss.

Incorrect. Suspending or ending the Constitution does not mean monarchy it means totalitarianism of whoever has the power, which would NOT be decided by a probative legislative body. Hence the pressing move to take firearms.

It also means, that if any of these “representatives” is heard to be spouting this, they need to be contacted and reminded that, this removal of the Rule of Law by our consented Constitution— would no longer be by our consent. Therefore there are no constraints on the publics actions against them— any and all actions. That is to say the “representative” would no longer have ANY position of legal authority no matter what they try to do to say they do.

It’s a fallacy to believe that any of our “public servants” give two damns about us or the constitution. They are all members of the most sophisticated criminal organization ever assembled. False hope empowers them and provides them cover.

Nothing short of torches and pitchforks will stop these thugs from robbing us blind. Until this happens nothing will change.
