He’s retired. They won’t call him back to active duty to prosecute him for this. Take that to the bank. Fact. This is total, unmitigated bullshit.

Also, Broadwell is an officer in the Army Reserves. If she was on duty at any time during her trysts with the general, she also can be prosecuted under the UCMJ.

If I remember correctly, Generals can be brought back at the needs of the service. He did not resign his commission, he retired.
One angle that hasn’t been looked at is, perhaps Patraeus and the gal, faked the affair knowing full well they could be blackmailed.
True. If he had admitted to a homosexual affair then he would be treated with kid gloves, and those who censured him would be called homophobic.
That's also adultery.
When does the prosecution start?
As none of this was known by anyone until an FBI investigation into his personal affairs, it was not prejudicial to good order and discipline nor did it reflect discredit upon the services, actually.
The next problem is that you have to a panel of senior officers would have to vote, after a trial on the evidence to convict. Let me just say that I wouldn't, and i don't know many others who would.
Finally after all of that is what the punishment would be. Discharge from the military would be the usual, but he is already discharged.

This is where we have arrived, a married officer can be prosecuted for adultery yet homosexuals are free to do everything they can do to wreck military discipline and morale. This is like sending jaywalkers to prison while encouraging drunken driving. I wonder just how long it will be before a “married” homosexual is prosecuted for sex outside of his “marriage”. I suspect the sun will burn out first. Insanity reigns supreme, we now live in the post-civilization, post-reason era.
Adultry is almost never charged at court-martial other than rape cases in which the accused is arguing consent, then it is a fall back charge.

A bunch of posters to this thread have apparently totally missed the point! It doesn’t matter one bit whether a particular charge is usually levied or usually not levied.
What does matter is that there are charges which could be filed by a vindictive regime. This means that veiled threats can be directed at Petraus in order to keep him on the reservation.
Consider the players. We have a “Chicago style” playbook applied to the UCMJ. Don’t you think Panetta is up to dragging Petraus through a very distressing prosecution? If you were Petraus would you be concerned? I’ll guarantee you that if legal action is taken against Petraus the MSM isn’t going to be there claiming incessantly: “It’s only about sex!” like they did for Clinton. Instead they will be throwing rocks to provide Obama cover.
As in chess, the threat of an attack is far more dangerous than the execution of said attack.
I think conservatives were trying to help him out- and nudge him to resign two weeks before the election.
I get the sense that he was trying to help Obama.
I remember thinking, at the time, that someone needed to step up and resign and face doing the right thing.
