State Dept: Texas can’t arrest international election observers

International election observers planning to visit Texas polling places have “full immunity” from being arrested in the United States, the State Department said when discussing a letter from the Texas Attorney General.

“I’m not going to get into any kind of hypothetical situations or predict where this is going to go other than to say we have every expectation that this will be worked out and to state the fact, which is that under U.S. law they are eligible for immunities,” said State Department spokeswoman Victoria Nuland. Reporters tried to get her to state explicitly that Texas could not arrest election observers from the Organization for Security and Co-operation in Europe (OSCE), but Nuland would only reiterate that OSCE observers have full immunity.

Attorney General Greg Abbott, R-Texas, warned OSCE that it “may be a criminal offense for OSCE’s representatives to maintain a presence within 100 feet of a polling place’s entrance,” as The Hill noted.

The case in point is OSCE’s coordination with Project Vote, an overtly partisan organization that was founded by and closely affiliated with ACORN. As you know, ACORN collapsed in the wake of a national voter registration fraud scandal that resulted in multiple criminal prosecutions for violations of state and federal election laws. Just this week, Project Vote boasted that it was advising OSCE on which issues to study—and which states to monitor—this election cycle. In light of Project Vote’s history of voter registration fraud and its more recent failed attempt to enjoin Texas election laws that were enacted to prevent fraud, no legitimate international body would affiliate with Project Vote. Consequently, OSCE’s affiliation with this dubious organization necessarily undermines its credibility and the independence of its election monitors.

They may be immune from arrest but I bet they can be detained, etc until the polls close before they are turned loose. Hell there are over 8,400 precincts in Texas so they’ll be hard pressed to visit a handful.

Why would they even bother being in Texas? Obama ain’t going to win Texas. Obama can’t cheat to get Texas.

It would be a complete waste of time for them. The UNdiots will be in Philly and Dayton.

Just because they have “diplomatic immunity” doesn’t mean that Texas officials are obliged to let them go wherever they like, afaik.

Exactly. They may not be able to arrest and prosecute them, but they can take them into temporary custody and hold them until after voting hours.

Nice smoke ring you're blowing there, Victoria - although I thought Foggy Bottom was a smoke-free environment.

If I recall correctly, diplomatic immunity was protection against prosecution, not arrest. Someone with diplomatic immunity can be held for 48 hours without any action required. So I hope these UN idiots enjoy their extended stay in Texas.

There are always the key House seat races and a LOT of in-state seats that are pretty key. State senate district 10 is one of them. A Democrat captured the long held "R" district by riding on Obama's coattails in 2008. She is a prime reason our redistricting process was dragged through the dirt (courts) for so long, and screwed up our primary date. She also pushed to sue over our new voter I.D. law.

Capturing control of large states is every bit as critical as national races.
