A street vendor hawking cellphone cases was slapped with $2,250 in fines for selling from a table that stood 1 inch too high and 2 inches too close to the nearest store entrance.
Alessane Fall who lives in The Bronx with his wife and six children intends to fight the three tickets he received from the same officer on Sept. 20 because, he says, city regulations are crippling entrepreneurs.
I dont know why the city is giving out tickets, but were here just to work, to feed our family, make sure our family goes to school, Fall said.
We come all the way from Africa looking for a better country.
Hell appear before a city administrative law judge next month.
One of the tickets states Falls cart was an inch over the 5-foot height limit for vending carts a violation that costs up to $1,000.
Defendant was observed with a vending cart taller than 5 feet 5 feet, 1 inch, the ticket reads.
When Fall measured his table for The Post, it came in at 4 feet, 10 inches but a clip holding down some merchandise pushed it to 5 feet, 1 inch.
The police officer who fined Fall wrote a second ticket claiming the cart was 2 inches shy of the required 20 feet thats supposed to separate a vendor from the nearest store entrance.
Fall insists he was more than 20 feet away.

Clearly, these infractions gave him an unfair advantage over his competitors.

I suspect this was likely an old-fashioned roust, probably on the behalf of one or more of the local businesses.
Now, it *is* possible there was some merit to the third charge - i.e. hawking in the sidewalk. I’ve seen vendors who get kind of aggressive trying to get people to look at/buy their stuff. Even IF that were the case, though, the Barney Fife routine on the height of the stand, etc. is totally unnecessary. If the guy was out on the sidewalk, the cop could’ve just warned him to ease off and let it go at that.

The scariest thing in regard to all this was that Michael Bloomberg ran as a Republican to win his first term as NYC mayor. His socialism is killing small business.
This gentleman who was ticketed....would like for him to move to Florida and set up business. Too many of the recent NYC transplants seem to be unable to handle working for non-NYC wages and no unions

Looks like he stands a 25% chance of getting it thrown out and I’ll bet all he has to do is ask.
The other 75% never bothered to ask.
And stay away from the entrance of the store(Like you can you really do that) It is annoying.
Looks like the ticket was written at 5th and Broadway.
I’d give him a ticket for even showing up. That is an awfully crowded area and likely he was infringing on the seriously hole in the wall businesses who store fronts are no bigger than my front door.
Additionally, the foot traffic there would be pretty deep. Though maybe not so much this time of year.
