NYC Board of Health passes big-soda crackdown rule

New York City's health board has passed a rule banning super-sized, sugary drinks at restaurants, concession stands and other eateries.

The regulation passed Thursday puts a 16-ounce size limit on cups and bottles of non-diet soda, sweetened teas and other calorie-packed beverages.

The ban will apply in fast-food joints, movie houses and Broadway theaters, workplace cafeterias and most other places selling prepared food.

It doesn't cover supermarkets or most convenience stores.

City health officials say the ban is necessary to combat a deadly obesity epidemic.

The restaurant and beverage industries have assailed the plan as misguided. They say the city's health experts are exaggerating the role sugary beverages have played in making Americans fat.

Some New Yorkers have also ridiculed the rule as a gross government intrusion.

I don’t know, but there’s probably 8 or 9 new agencies in NYC writing regulations on it, and hundreds of bureaucrats ready to enforce this.

Freedom. They apparently just don’t fully get the concept in NYC.

Nope. When someone goes in, they will buy one soda and be done. Before they would buy the biggest soda as it was the “best value”, but it was also the best price point for the theater.

Now people will buy a smaller popcorn (because in their minds they won’t have enough soda to wash it down) and a 16oz soda. Instead of spending $14 for a large popcorn and soda, they will be spending $8 for a small popcorn and soda.

It will cost theaters thousands of dollars a week.

Thanks for that highly relevant clarification. I’d have to run a McDonalds to use my fix to this idiotic legislation. How about burrito stands, does it apply to them?

I believe it applies to all street vendors and all restaurants. I’m surprised 7-11 isn’t included because they also sell prepared food, but it’s not (or at least the last I heard). I don’t know how the food store/delis will be judged.

And, to someone else’s point, diet sodas are not included.

Good luck finding a place in NYC that doesn’t have the fountain behind the counter, though. Too many people and too many homeless to take a chance on letting the public serve themselves.

You solve that by selling them 2 16 oz sodas, and one 32 oz cup. Hand them the sodas, let them pour the contents into their own, personal one cent cup. They could also use those 32 oz plastic cups that are refillable; just bring them in and ask for 2 16 oz drinks and say FU to Mayor Nannie.

New York has a cup tax for fountain sodas.

They know that this won’t stop people from drinking the amount of pop they do, but it will force them to buy a second cup.
