Larry Craig: MSP airport bathroom trip was part of official Senate business

BOISE, Idaho -- Former Republican U.S. Sen. Larry Craig aims to fend off a federal election lawsuit against him by arguing his infamous July 11, 2007, Minneapolis airport bathroom visit that ended in his sex-sting arrest was part of his official Senate business.

Craig is hoping to avoid repaying $217,000 in campaign funds the Federal Election Commission claims he misused to defend himself.

The FEC sued Craig in June in U.S. District Court in Washington, D.C., alleging he converted the campaign money to personal use by spending it on his legal defense after he was accused of soliciting sex in a Minneapolis-St. Paul International Airport bathroom. The commission argues Craig's defense had no connection to his campaign for federal office.

At the same time this looks like a sort of harassment not proportionate to the offense.

He probably ought to countersue the DNC for a share of the campaign funds his shenanigans enabled them to raise for the 2006 election!

I am still amazed that laws are applied so disproportionately at Pubbies.

Has anyone every been busted at that airport for such activity? How did the information get out so quickly to the press? Almost like an Axelrod sponsored DNC memo.

From what I remember, his Senate duties DID provide him a legal cover for the trip home and its aftermath. I fly through that airport every few months and it just seems incredulous that it is possible to think up such a scheme.

Was he guilty? Who knows, but it just smelled too much like a setup.

Ask former Rep Ryan of IL on his opinion on these tricks.

Honestly, based on what comes out of congress these days a bathroom trip would be a step up. I sure as heck don’t see Obama repaying for his daughters being on the manifest as “Senior Advisers”.

Maybe so, but his defense here is a pretty interesting one -- and has a legal basis that may or may not be relevant in this case.

The specifics of his case notwithstanding, the scenario in this case is exactly applicable to Article I, Section 6 of the U.S. Constitution -- which prohibits the arrest of a member of Congress while conducting Congress' business and while traveling to and from Congressional sessions. This provision dates back to a time when everyone had to travel on foot or on horseback, and was included in the Constitution to prevent officials in State A from arresting a member of Congress from State B who was traveling through State A on his way to Washington.

Apparently fame is extremely addicting to some people, even more so than crack. 15 minutes of fame and they are hooked and will do anything, anything for more of it, even joining America’s criminal class: Congress.
