At the same time this looks like a sort of harassment not proportionate to the offense.

He probably ought to countersue the DNC for a share of the campaign funds his shenanigans enabled them to raise for the 2006 election!

Honestly, based on what comes out of congress these days a bathroom trip would be a step up. I sure as heck don’t see Obama repaying for his daughters being on the manifest as “Senior Advisers”.

Maybe so, but his defense here is a pretty interesting one -- and has a legal basis that may or may not be relevant in this case.

The specifics of his case notwithstanding, the scenario in this case is exactly applicable to Article I, Section 6 of the U.S. Constitution -- which prohibits the arrest of a member of Congress while conducting Congress' business and while traveling to and from Congressional sessions. This provision dates back to a time when everyone had to travel on foot or on horseback, and was included in the Constitution to prevent officials in State A from arresting a member of Congress from State B who was traveling through State A on his way to Washington.
