My USC says you are wrong. Therein it clearly states that USG does NOT have the power to lay direct taxes. This is a state power, just like and similar to police power. This is because the power to directly tax is similar to the power to _force_ with armed men a citizen’s compliance. Our fathers _never_ intended to allow DC to directly tax citizens.
Further, USG is _stealing_ direct tax money from the state, with this ongoing scam. Reaching past the state and taking it’s money, without so much as asking, then bribing and coercing states to do as USG wants, to get some of it back.
Then it IS UNCONSTITUTIONAL and needs to die.

So take your Pick,SOME Republicans are calling it a Tax because that is Toxic to Democrats and they Know it,But others are calling it the Penalty because that makes it Unconstitutional. Take your Pick but either way we are screwed
Is it an excise?
Is it an impost?
Is it a duty?
Is it apportioned among the several States?
Is it a tax on incomes, wherever derived?
Those are the taxing powers delegated by the People of the several States to Congress.
This constant repetition of “it’s a tax” is idiotic. It’s NOT a tax, the fact that John Roberts says otherwise can’t change reality.
