I’m Not Down on John Roberts

. . . I get the strong sense from a few anecdotal stories about Roberts over the past few months and the way he has written this opinion that he very, very much was concerned about keeping the Supreme Court above the partisan fray and damaging the reputation of the Court long term. . . .

Second, in writing his case, Roberts forces everyone to deal with the issue as a political, not a legal issue. . . Third, while Roberts has expanded the taxation power, which I don’t really think is a massive expansion from what it was, Roberts has curtailed the commerce clause as an avenue for Congressional overreach.

So Roberts wanted to be nice, and ignored the Constitution. And that is why we should say “Good Job!!”

This decision has made it possible for the government to tell every property owner that they MUST have solar panels installed and operating or pay a fine.

Since Congress levies taxes, we must always make sure we have a congress in place that's on our side.

LOL Except that it isn’t a tax because it cannot be defined as one.

Is it:

A Sales tax? No. no sale here.
An income tax? Nope no income here.
An investment tax? No investment either.
A death tax? Nah.
A corporate tax ? Nope. it is on individual as well.
A real estate tax? no.

Well what is such a thing as this if it is not a FINE for not purchasing something that the government ORDERS you to buy as a consequence of living in America?

It walks like a duck... not a tax

Obama has thought this through. He is legitimizing millions of illegals and inviting many more to come in who will miraculously have the documentation to prove they have been here for five years. He will issue them work permits and his proxies will assure that they are illegally registered to vote. His DOJ is at war with the states to make sure they cannot purge or safeguard the voter rolls. This is the strategy to assure an Obama victory - millions of illegal invaders who are being invited to loot the country by Dear Leader in exchange for their support.

Well, not really. The idea of “on to Congressional repeal!” would be fine, except that we now live in the era of everything-must-pass-the-Senate-with-60-votes.

They passed this monstrosity with reconciliation, they can repeal it with reconciliation. 51 votes controls the senate. 51 votes can change the rules of the senate. 51 votes and the courage to exercise that control is all we need.

Yesterday I saw someone had posted, "Justice Roberts is an originalist, not a conservative." This vote would tend to support that assertion, as Marbury vs. Madison--the case which established the principle of judicial review--was not part of the original document.

The silver lining is that Roberts put the kibosh on the Commerce Clause. (and much mischief has been done under that woeful clause)

Being a tax throws it back to Congress. If you don’t like it there is a simple solution.....vote Republican in 2012.

The Tea Partiers we voted in in 201 have voted consistently for totalitarian laws. Why do you think more tea partiers in Congress will be any better? This is the “when we still could” time as in “Why didn’t I leave when I still could?”

You don’t think this is an expansion of power?

It took a Constitutional AMENDMENT to enact income tax authority, but just gave the government UNLIMITED taxing authority!

SCOTUS says the US Government can tax your INACTIVITY!

They can tax your for BREATHING and EXISTING!

I would say that is was the MOST expansive decision in American History! They just made the US Citizen a ward of the state!

What does that communist monster have over Roberts though! Roberts has made some very good, patriotic decisions and then this happens! Kim J-obama Il must have gotten something to use against him Holder and his cronies must have pulled something very, very bad and personally damaging to Roberts family or loved ones to force this kind of horrible, destructive, Maoist decision out of him. We may never know because if Dear Leader is re-elected he’l purge records AND people!!!

Now Congress can make you do anything they want you to. Anything.

All they have to do is hit you with an onerous fine if you don’t do it, except the fine is called a tax.

So it was passed as NOT a tax, but upheld as a tax.

Shouldn’t that mean it has to be rewritten and not upheld?

If Roberts were a politician, he would be another Republican bragging about how he can compromise with Democrats. There is nothing particularly difficult or requiring enlightenment about it, and nothing courageous. Place the appearance of rising above partisan politics in the court over Constitutional integrity and liberty, and kick the ball down the court, back into the field of incompetence where the mess was created in the first place. Meanwhile, the American people keep getting screwed.

FDR got his COURT eventually and fastened the steel blanket of Depression on the nation. Now the kenyan has his COURT and
the transformation is next to complete. He doesn’t have to leave office in January. A Soros Company will be counting the electronic votes and there will be no evidence of the actual vote at all except for the Soros count. The only question, I think, is will they be satisfied with the presidential election or will the Senate and House go Democrat, too? And if they do, what do you suppose can be done about it? There will be no smoking gun.

Correct.
The Tea Party was a PR tool. It didn't accomplish anything, and will not.
Just like OWS won't. Just like electing Rombot won't.

The real question is what do we do now?
