The Tea Partiers we voted in in 201 have voted consistently for totalitarian laws. Why do you think more tea partiers in Congress will be any better? This is the “when we still could” time as in “Why didn’t I leave when I still could?”

So it was passed as NOT a tax, but upheld as a tax.

Shouldn’t that mean it has to be rewritten and not upheld?

Correct.
The Tea Party was a PR tool. It didn't accomplish anything, and will not.
Just like OWS won't. Just like electing Rombot won't.

The real question is what do we do now?

Without GOP ruling the House, what do you think we would be looking at now? I shudder to think.

Tea-Party politicians are not the majority anyway. And they have to win future elections. Overall they did 200% better than democrats. Compromise is always the reality. But it matters very much how far to compromise.
