WASHINGTON (Reuters) - A U.S. appeals court on Tuesday upheld the first-ever U.S. proposed rules governing heat-trapping greenhouse gases, clearing a path for sweeping regulations affecting vehicles, coal-burning power plants and other industrial facilities.
Handing a setback to industry and a victory to the Obama administration, the U.S. Court of Appeals for the District of Columbia unanimously ruled the Environmental Protection Agency's finding that carbon dioxide is a public danger and the decision to set limits for emissions from cars and light trucks were "neither arbitrary nor capricious."
The ruling, which addresses four separate lawsuits, upholds the underpinnings of the Obama administration's push to regulate carbon dioxide emissions, and is a rebuke to a major push by heavy industries including electric utilities, coal miners and states like Texas to block the EPA's path.
In the 82-page ruling, the three-judge panel also found that the EPA's interpretation of the Clean Air Act to regulate carbon dioxide regulations is "unambiguously correct."
The court also said it lacked jurisdiction to review the timing and scope of greenhouse gas rules that affect stationary sources like new coal-burning power plants and other large industrial sources.
EPA Administrator Lisa Jackson said the court found the agency "followed both the science and the law in taking common-sense, reasonable actions to address the very real threat of climate change by limiting greenhouse gas pollution from the largest sources."

Was watching Greta last night and Dick Morris was on and they were talking about fast and furious. Well, towards the end of his interview he said: by the way, Hillary is in Brazil to set up an international “world” EPA, and is giving them 2 billion dollars. Greta says, what does this have to do with F&F? (clearly unscripted) he said it has nothing to do with it, Its just a really big deal and the American people should know.
I agree with Dick Morris, the American people need to know how Obama and his cohorts are selling the country to the UN.

To put it in military terms from 1965, (I don’t know the current jargon) it amounts to a combination of a Circle —— and a Cluster ——. It has absolutely nothing to do with science, a gathering of Shamans would be far more scientific. My very limited exposure to judges leads me to believe that most are incapable of remembering that they are not Gods.

In fact, I’m not entirely convinced that the man wouldn’t do worse than Obama — oh he wouldn’t be quite so blatant about it — but didn’t even Bush give us the Patriot Act and start the bailouts? Simply put I do not trust the Republican-party not to solidify what ‘precedents’ have been made, with maybe a token ‘win’ here or there, and the selection of Romney only heightens my distrust.

Since we are a Sioux Nation, a lawsuit with a lawyer from Missouri will show harassment by Big Brother EPA to be the cause, because the EPA will not be able to demonstrate cause and effect.
All of their “proof” is cicumstantial, observational and based on statistical inference. Anomalies, such as the 1940’s CO2/Temperature anomaly are ignored. I believe their term is “smoothed out.”
By any legal test: beyond a reasonable doubt, beyond a probable doubt, beyond a possible doubt, etc., the bullies at the EPA will not win a court case based on cause and effect because THERE IS NO KNOWN CAUSE AND EFFECT!
The UN “Study” of Global Warming is based on computer modeling of over 200 variables using statistical INFERENCE.
Hence, the UN “Study” is untestable due to the number of variables, and based on inference not deduction.
Politicians love this kind of study because it is pure junk science, and thus appeals to their grade-school imaginations. Enter the EPA and Presto! The well-educated roll over and submit to the leg irons of the thought police of the day. That submissive behavior only encourages the bully! Stand and fight ‘em!
If you think that you are smarter than Algore, then find yourself a “Show-Me” Missouri Lawyer, and whip the EPA Bullies for all of us to see!
BTW, US Sen. (R. Ok.) Inhouff wrote a great book this year on the GW Myth. Read his book and bounce these ideas off of him. He will be a good ally.
The problem with Romney in office is that the mess of Obama will not be cleaned up but made status quo, and have 'precedent', all that other fun stuff. Also, I'm not trustful of the Republicans, there are some who seem decent enough... but we should remember things like Patriot Act, TARP, NDAA and how they have NEVER (at least in my political lifetime) as a party made strides toward smaller and more responsible government (indeed the same could be said of many of the party planks, like overturning Roe v. Wade).
