Delegates Heading to Tampa Sue the GOP

The federal lawsuit, filed this week in U.S. District Court in California demands the delegates be freed to "vote their conscience" for presidential nominee at the party's August national convention in Tampa, Fla., rather than being "bound" to vote for a certain candidate, as many state party bylaws require, based on the primary elections and other delegate selection procedures. Courthouse News Service reports at least another 40 additional national convention delegates have asked to join the lawsuit which would bring the total to 160 Delegates.
Yet striking down party rules that bind candidates to vote in accordance with the primary process could suddenly open up the nomination to another campaign season, as presidential hopefuls could attempt to sway the elected delegates to their side, a potentiality Gilbert recognizes.

When the Convention Chairman, Brooks Patterson, came out to announce the outcome, he introduced Saul Anuzis as the next podium speaker, and I felt immediate disappointment, which was short lived...Anuzis then introduces Dave Agema as the new RNC Committeeman, and the room exploded in the loudest, most prolonged ovation and demonstration of the day....We had made our presence felt in a significant way, and the confirmed election on Terry Lynn Land as Committeewoman was almost an afterthought...We had successfully replaced both representatives from Michigan to the National Committee, our message to the State powerbrokers could not be more clearly stated...."Your time is up, it's our turn!"...
Michigan's conservative movement made huge strides over the weekend, and the message is now guaranteed to be carried to Tampa and Washington D.C...As I left the floor at Cobo, a long line of conservative activists were manning the railing behind the delegate area, exchanging "high-fives" with everyone as they left....we had legitimately proven we could beat the establishment at their own game, using their own rules...it was a marvelous feeling...Michigan has set the tone for the national convention, let's hope the nation is watching...

I have helped several times with campaigns in the past; Rick this year, but really don’t know anything about how everything works. I was selected to be a state delegate, but bowed out because I won’t back romney. Does this mean, we will have another choice besides romney at the convention? Maybe a conservative?

"According to two sources from the unofficial "Ron Paul" convention, at last count 31 of 44 delegates and alternates that could be confirmed were Ron Paul supporters...This, if true, presents the GOP a major problem in Tampa regardless of the Presidential primary outcome, true conservatism will be represented at the Convention, and will have to be acknowledged and accommodated in some manner..."
Wow! Have the Paul supporters done similarly in other states? If so the convention could be very interesting this year! ;-)

While you have a point and rules use to be rules, the natives are restless and have figured out that the convention is a coronation, the process is rigged and the delegates are there as the dupes to pull it all off, usually wearing large and hidious hats and blowing horns.
These delegates are grassroots, foot their own bill to get there and are not all rich. This year, it happens that they’re mad as hell and not going to take it anymore.

And under what jurisdiction does a Court have to overrule the internal by-laws of a political party? Did they have a separate contract guaranteeing them the right to not follow the by-laws that would allow them to have a cause of action? This makes no sense to file a lawsuit.

Well if the gop/e were not running the party like Tony Soprano’s crew... we would not be in disarray. The republican leadership does not represent me... they do not represent republicanism... they despise their own base. When republicans are as divided as we are... what do you expect?
