Dershowitz: Zimmerman prosecutors should be investigated (References Mobile, AL racial beat-down)

Harvard Law School Professor Alan Dershowitz believes the prosecution team in the George Zimmerman case should be investigated to see if they committed a criminal act.

On the Glenn Beck radio program today, Professor Dershowitz said he does not believe the Florida prosecution team had sufficient evidence to charge George Zimmerman with second degree murder in the death of Trayvon Martin in Sanford, Florida. Unless there is additional evidence, Dershowitz believes the second degree murder charge is baseless. Dershowitz added that he does not see any justification for the prosecution to withhold evidence.

Furthermore, in an explosive charge, Dershowitz said he believes the Florida prosecution, may be guilty of committing an ethical violation, and potentially may have committed a criminal act by charging Zimmerman with second degree murder. If the prosecution had access to a photograph showing the bloodied head of Mr. Zimmerman, taken immediately after the incident on February 26, there was no basis for a second degree murder charge, according to Dershowitz. If it were proven that the prosecution had access to the photograph, and filed a second degree murder charge anyway, Dershowitz believes they may be guilty of Subornation of perjury which is a very serious charge.

In a tragic situation that occured in Mobile Alabama yesterday, a mob of African-American adults allegedly attacked a white man who had approached some African-American youth about playing basketball in the street. The mob used chairs, pipes, and paint cans to beat the man who is in critical condition. According to a witness at the scene, one of the attackers allegedly said, 'Now that's justice for Trayvon'....

Also reported today on FNC is that George Zimmerman is out of state and that he is relying on donated private protection services. He has no official police protection.

Let's not get carried away. Dershowitz has made some pretty outlandish charges against conservatives over the years.

My opinion of him has not changed one bit! I disagree with him on almost everything political, but I’ve always liked him! His perspicacious application of his intelligence and education, and his honesty, has always made for interesting interviews and conversations,,, as opposed to someone like Shultz or Odorman!

In the old days in the South, black people could not expect justice in any case that involved white vs. black or a white person's testimony vs. a black person's testimony.

This case is going to make white people, at least those not taken in by the media, realize that the situation has now exactly reversed itself. In a white vs. black case, the white person cannot expect justice--at least not if anyone stands to benefit from a miscarriage of justice.

At least in the Nifong case, the students were eventually cleared. It's not certain that Zimmerman will be cleared or that he will avoid being killed.

Yes, that gives me much more confidence that nothing Hitchen will do in the future will be thrown back in my face over this praise than in the case of Dershowitz. It is always safer to praise dead honest liberals than live honest liberals who may next week decide to make an about face and start toeing the PC line.

Then again at one time after reading the “Read Anita Hill” I was a fan of the conservative David Brock. So anyone you praise can later become an idiot.

Serious question.

Who investigates the investigators? Specifically at the State level.

Who would appoint a "special prosecutor", if that is the correct term, to investigate inappropriate actions on the part of Angela Corey and her department?

I think as suggested by others we need to apply serious pressure to the right individuals or branch of government to take action and not just talk to ourselves about it.

Dershowitz would have been a much better SCOTUS than Kagan or Sotomayor (who together have a combined IQ close to 100). But he is still a LIBERAL.

He is right on when it comes to Israel and if I were accused of a crime, I would want him on my defense team. But there is no way he should be on the Supreme Court. He is as left wing as they come on social issues.

A couple of legal points:

If the prosecution violated the law in not presenting all the evidence, then prosecute the prosecutors.

They are not required to at this point, in a charging document, but the document itself contains enough information so there should never have been a charge, as it indicates there are required elements of the charge that they admit they will never be able to prove.

They should go after the people in the MSM who edited the tapes and pictures to stir up racial hatred.

That is a First Amendment issue, resolved by viewers and readers turning away from those media. The First Amendment makes the media free, but also allows them to be wrong and stupid. That said, if he is not found guilty, Zimmerman as multi-million dollar cases against a number of media outlets.

They should prosecute the New Black Panthers, Civil rights leaders and anyone else who has called for violence.

Tough to do. It could be called protected opinion.

They should prosecute any assault that claims to be for Trayvon, as a hate crime.

Sounds like this prosecutor overcharges to force the accused to plea to a lesser charge. The charge on that 12 year old sounds ridiculous for the alleged events that occurred.

I thought he said 'punks' FWIW and it makes sense in context. But big whoop if he did. That's not enough to establish intent to kill except to the most delusional idjit. Zimmerman does have a record of stopping crimes with his calls to police in the past and there were about 15 breakins and burglaries in the recent past so his intent to honestly prevent crimes, handle them legally and a frustration that there were quite a few crimes is easy to establish and provides more than reasonable context for using the word 'punks.'

The affidavit is a mind reading act.

Martin was unarmed and was not committing a crime.

Not in evidence that he was or wasn't.

...by Zimmerman who didn't want the person he falsely assumed was going to commit a crime ...

Al and Jesse may have jumped on this bandwagon just to get some TV face time. Barry undoubtedly thinks (rightly) that this brouhaha will give him time for unrelated skulduggery. Eric “Mypeople” is the one among the four who may be cunning enough to see where this is likely to go, and to keep it on track to work against all americans, but for him and his (excluding ordinary blacks, in whom he may have no interest).
