MIAMI (CBSMiami) George Zimmerman has been charged with second-degree murder for the shooting death of 17-year-old Trayvon Martin, according to the Associated Press.
Additionally, Zimmerman has been taken into custody, but it hasnt been revealed where he is being held.
CBSMiami has confirmed that State Attorney Angela Corey, who was appointed as a special prosecutor in the case, will hold an announcement about the charges at 6 p.m. in Jacksonville.
That press conference can be viewed LIVE starting at 6 p.m. by clicking here.
Seems kind of circular. There isn’t a defendant until a crime is charged, and it’s assumed that there’s a crime unless a defendant says why it’s not a crime...
If “defendant” just means the person who is suspected, then Zimmerman already DID assert self-defense, to the police. This would only be an unlawful death if that assertion can be disproven. At least if a person is innocent until proven guilty.
this Cory lady is totally on Martins side...disgusting
Absolutely revolting. She was smiling. The way she was cheery and happy was out of place. I was expecting her to announce she's running for congress. The woman is full of herself.
*They hand picked this case* is right. Th AP collects thousands of stories from all over the country every year. They can make a mountain out of a mole hill or make a mole hill out of a mountain. In a country of 300 million people there are going to be all sorts of crimes in the course of a year but the mainstream media has the option of choosing which stories are going to be huge national stories that all Americans will hear about and which stories will be swept under the rug. One of those stories that was swept under the rug and did not become a national headline was the case of a thirteen year old white boy in Kansas City who was doused with gasoline by two black boys and set on fire.
It is all about shaping the nation into what they want it to be. Blacks must always be angry and whites must always be paralyzed by guilt.
In your blog you write...”Zimmerman gets out of his car. He tells the dispatcher he was going to follow Trayvon.”
I’ve listened to the call several times. Where exactly does he say this?
No. He's not remotely close to the definition of aggravated stalking under Florida law. You quoted both Florida Statute 782.04(2) and (3). Each of them defines the elements of Second Degree Murder in the State of Florida, but they're separate. She can charge Zimmerman with Second Degree Murder under 782.04(2) based on what the law deems a 'depraved mind' - that's going to include acting with hatred toward another, such as a racial element, or a 'punks' element, if she wants to claim it.
If she does that, she never even touches 732.04(3), which is where you found 'aggravating stalking.'
Aggravating stalking's going to require you to go to Florida Statutes 784.048, generally, and 784.048(7) specifically. That's not going to happen. First, 'constitutionally protected' activity can never be the 'course of conduct' necessary to establish stalking in Florida, per 784.048(1)(b). Second, you must be sentences for stalking and prohibited from contacting the victim, and then still do so, for it to be aggravated stalking. That's the definition of 'aggravated stalking' under Florida law (Florida Statutes 784.048(7)).
It's clear she's not going there. This is a 732.04(2) Second Degree Murder charge, base on some hatred or enmity element leading to a depraved mind. It has nothing to do with aggravated stalking and 732.04(3), in my semi-informed opinion.
"But on Cristian's behalf, there is international outrage. More than 170,000 people have signed an online petition, urging the prosecutor to treat the 12-year-old as a juvenile, not as an adult. [Corey] disagrees, and says Florida law is Florida law.Complicating the Fernandez case is the role of the mother, Susana. Police say during the several hour window between when David was injured and she drove him to the hospital, her laptop shows that she searched what to do about an unconscious boy, checked her bank and downloaded music, before finally taking 2 year old David to the hospital.
A doctor at St. Lukes told a police officer that had 2 year old David been treated sooner, he may have survived."
“Politics is in complete control of the legal system, but we all know that. The cowards in government don’t want to tell the child like minds of savages they have had enough *rule of law bending* and can’t have any more, but we all know that also.”
Amen to that.
This is another war zone now so they applied some state department thinking here: let’s not worry about the facts of the case, let’s worry about appeasing poor ahmed’s family. That, of course, doesn’t apply down at Ft Hood where they’ve been waiting 500+ days for Hassan to see a courtroom while his defense team asks to see every xerox copy of each original photo that’s been put to a copy machine, pretending they’re being denied access when they’re just delaying.
But Mohammed’s in the details on that one, and he’s protected. And this is Trayvon, and he’s protected. And Jorge would generate sympathy, because he’s protected, but Zimmerman isn’t protected and neither is Martin.
Therefore, it’s Zimmerman and Trayvon and a war zone prosector looking to provide good feelings of justice to the inhabitants of the war zone.
And, of course, it’s a Republican. It was Republicans who wanted the Hadithites to feel “justice” over the prosecution of our Marines. And not our republican president, nor SecDef, nor SecNav, nor any Senator or Congressman spoke up at the injustice of it all.
Is getting out of your vehicle “picking a fight”?
If so, you better park your vehicle at the drive-through or you’re gonna die of starvation since you can never get out of your vehicle once you get in. lol.
Trayvon was staring at Zimmerman. Is that “picking a fight”? Why or why not?
You think Zimmerman TRIED to “start losing”? You think he WANTED a broken nose and a gash on the back of his head, so he’d have an excuse to shoot?
Zimmerman had lost Trayvon and was headed back to his truck. Anything Zimmerman initiated was done at that point. Trayvon was free to go home without Zimmerman even knowing where he was at.
But Trayvon didn’t let that be the end of the story, did he? His girlfriend heard him ask Z why he was following him, Z ask why Trayvon was in the neighborhood, and the next eyewitness account we have is from people saying that Trayvon was on top of Zimmerman.
No way did Zimmerman have a gun pointed at Trayvon and Trayvon still initiated a conversation when he could have slipped away and been home within 2 minutes. Not likely Zimmerman pulled a gun on Trayvon in response to Trayvon’s talk and still ended up with Trayvon on top of him.
The one who picked the fight was apparently Trayvon. So a more apt post would be.....
“sooo. let me get this right...
If I pick a fight by busting a guy’s nose and banging his head repeatedly on the ground and he shoots me in self-defense I can get the guy I attacked jailed for life or murdered by the Black Panthers?”
It is all about shaping the nation into what they want it to be. Blacks must always be angry and whites must always be paralyzed by guilt."
The only way to counter that is for a national news org to go to KC and interview all the particulars and put the white boy's parents on tv, demand justice, etc, etc.
There are only two organizations that could pull that off -- Fox and Breitbart -- and Breitbart is gone. Fox isn't going to do anything, so we need another Breitbart. Like right now.
But our damn money is sure welcome, that’s why black majority cities either want to annex white communities, or (as with Detroit) raise hell at the prospect of emergency management while still demanding more federal money (our taxes) be thrown down the black hole. It’s why as much as they claim to despise us, whites can’t have white communities-they lack “diversity”-but black communities are “chocolate cities” and such. Only white neighborhoods and white nations are required to make room for “diversity”, no others. If I thought a group of people in general were at the root of all my problems, I’d stay away from them—and I do. But parasites need a host, even though their presence kills that host and eventually themselves. Before it’s over I and my family will be living in some hard-to-reach remote Appalachian area just to have freedom of association and to protect ourselves from the “zombies”.
You calling TRayvon’s girlfriend a liar?
I don’t understand why people do not see this as a win-win.
1. George was not safe, did not have the resources to live in hiding and presumably wanted to tone down the fury.
2. The wind is out of the sail of the race baiters for the moment. No summer riot or retaliations, hopefully.
3. His former lawyers, the police and Distric Attorneys are insulated from current threats.
4. It is the most slam dunk case of self defense imaginable.
5. George is now protected and nothing will happen with this case until after the election.
p.s. I suspect George will be treated with the utmost deference by his jailers
Must have been some chat between Michelle Williams and Corey, woodenyasay?
The Trayvon Martin case has got me thinking of a horrible crime that happened in Ohio. A black pimp kidnapped two white teenage girls aged 14 and 15. These girls were raped, beaten and forced into prostitution. They were missing for weeks when someone recognized them and reported it to the police. The girls were finally rescued. Could someone with a knowledge of law tell me what this creep should have gotten according to the law? Could you list the number of crimes this beast committed and what the punishment for each crime would be? When you answer, I will let you know the sentence the pimp actually got.
Can you say Sacrificial lamb.
Can you say lamb to the slaughter.
Yeah X. We’ve seen this movie.
I'm not saying it's right - I'm just trying to guess her strategy.
Because - it's not 782.04(3) and a death during 'aggravated stalking.' There's a definition for 'aggravated stalking,' and it simply doesn't apply to Zimmerman. She has to be going with 732.04(2) and what's commonly known as 'depraved indifference.'
I had similar thoughts. The Prosecution will present the evidence, which is minimal. The Defense will have the videos of George’s injuries, the audio of him screaming as his head is being bashed, the witness who saw him being beaten, the testimony of the black children George and his wife mentored, etc., etc., etc.
For now, he’s relatively safe (they’re not saying where), and the DA has charged him so the media is off their backs.
