Teacher's aide suspended for refusing to let school look at her Facebook page

A teacher's aide was suspended after she refused to let the school district she worked access her Facebook profile. Officials at the Frank Squires Elementary School in Cassopolis, Michigan insisted they check Kimberly Hester's account last year after she posted a picture of a co-worker wearing pants around the ankles and a pair of shoes. The woman is trying to take legal action against the school now that she has been put on unpaid leave.

She told WSBT-TV: 'I did nothing wrong. And I would not, still to this day, let them in my Facebook. And I don't think it's OK for an employer to ask you.' She went on to say: 'I have the right to privacy.' A parent who Facebook friends with Hester alerted the school about the picture.

That is when Robert Colby, superintendent of the Lewis Cass Intermediate School District, asked Hester to see her personal page on the social-networking site. Ms Hester said of the encounter: 'He asked me three times if he could view my Facebook and I repeatedly said I was not OK with that.' The district put her on paid administrative leave after she refused to provide Mr Colby access to her account. The school later suspended her and stopped paying her.

The problem with this is three fold:
* Personal pages versus private pages mean that the page they look at may not be the one in the complaint.
* They may decide something based on a Facebook page of someone else.
* If the person had her pants around her ankles in public, it may not be the fault of the person who posted the picture but the person who put themselves in a compromising position. (If you don’t want pictures of yourself doing drunk stupid stuff on the web, don’t get drunk enough in public to do stupid stuff.)

It's a violation of your user agreement to relinquish your password to any third party.

Anyone demanding passwords to FB or any other private accounts should be sued.

Setting aside the issue of how stupid it is to post things on FB that you wouldn’t want certain people to see, the idea of an employer demanding to have access to a personal site is outlandish. It’s the equivalent of their requiring access to your gmail account.

That said, the media is not writing these stories well. The impression in many instances is that employers are asking for passwords. That would be ridiculous; they want to view the pages. I have yet to see one company named that has asked for login information, but that doesn’t stop the media from reporting it as an emerging phenomenon.

I think employers have figured out that accessing applicants’ and employees’ Facebook accounts is a back door to acquire information that is illegal to request on an application. You can’t ask a person’s age, gender, race, etc., on an official application, but most of that info is shared freely on social networks. Demanding access is stunningly illegal for this reason alone

(Most applications have a section asking for some of that info for diversity reporting, but filling it out is optional.

Just as every Socialists in recorded history has done, the first group to be eliminated by obama will be the fools that put him power. How he will go about doing this, I cannot say. But I do know that as sure as Monday follows Sunday that he will. He actually hates and distrusts them more than he does us.

I do believe the ultimate secular authority will be manifest more as a Facebook-like entity — popular, then ubiquitous, then, before you know it, inescapable; offering perks then rationing necessities — at least in its early stages. And I agree that it is here. It’s just a matter of degree now.
