Kennedy apprears to be very critical of Mandate provision. LA times headline "Justices signal possible trouble ahead for health insurance mandate," they note:

“Are there any limits,” asked Justice Anthony Kennedy...

“If the government can do this, what else can it … do,” Scalia asked?

Politico headline, "No Fifth Vote Yet to Uphold," ...

"The conservatives all express skepticism, some significant. They doubt that there is any limiting principle.

Unthinkable then, mandated now. Poverty is, for most practical purposes, illegal (minimum wage + welfare = you have no excuse to be "poor"). Sickness is nearly there too, with Obamacare plugging the remaining holes amid Medicare, Medicaid, and other comparable programs.

I don’t think they can “smoke and mirrors” around that.

Besides, one of the major reasons that leftists want it is the “compulsory” aspect of it. Without compulsion, making someone do what they want them to do against their will, what’s the point (to a leftist)?

They’ll just switch to “well then, the Too Big To Fail healthcare industry is about to fail, so we’ll just tax everyone straight up for the costs”. Exactly where they wanted to go.

One good thing we have going for us is that the looney left Justices may actually want to do what is right just before retiring, so as to have something laudible to be remembered for, like dumping the whole thing as unConstitutional.
