A motorist who was pulled over after driving erratically and was methodically kicked in the head by a Henderson Police officer while being videotaped by a Nevada Highway Patrol dashboard camera will receive a $158,000 settlement.
The motorist said he was weaving because he was in diabetic shock. Police found a vial of insulin in his pocket. The settlement amount was blessed by the city attorney then approved by the Henderson City Council tonight.

I think he should get a lot more for getting kicked in the head 5 times. What’s the average IQ of a cop? 100? Somebody should lose their job.
The next time a patrol officer pulls someone over and gets shot for his trouble remember this. There is no excuse imaginable for this kind of conduct by law enforcement officers. They acted like ghetto punks out “wilding”. Even if the driver had been intoxicated as they appear to have suspected what possible reason is there to act in such a fashion? When law enforcement becomes more criminal than the criminals what purpose do they serve? Kicking someone multiple times in the head for no reason whatsoever should be sufficient to bring charges of attempted murder against at least one officer with the others being charged as accomplices. What are we coming to?
This poor guy must have had an idiot for a lawyer.
The cop part of Mittens election squad?
The descriptor used to be "Peace Officers".
I miss Peace Officers. I have no use or tolerance for Law Enforcement Officers.
I had a great deal of respect, bordering on reverence for Peace Officers back when there was such a thing.
“Whats the average IQ of a cop? 100?”
The average IQ of everybody is 100, that’s its very definition. Cops on average are probably a little lower, I’d say 95-ish. There’s a few that are intelligent (I’ve never heard of one even marginally genius), but most of them are the scum of society. At one time period, that may not have been true, but they’re certainly attempting to get the worst thugs around, because it perpetuates the war on the citizenry. Police work by nature is corruptive, and those who are social misfits gravitate towards police work. In fact, if you look at most cop families, I would guess you’d see about half of the family being cops and half being convicts, or at least a corresponding percentage (I have known several, personally, and worked with or provided services for, countless more). LVMPD (neighboring Henderson), are some of the most corrupt police on the planet. The sheep dogs have all become the wolves. That’s why Sheriffs are to be voted in and out by the citizenry. Not municipal corporate police systems with lifetime taxpayer sucking, parasitic jobs.
Someone should not only lose their job, but be held personally liable for the settlement and criminally prosecuted. And then some.
I sat on a trial a few years ago where we found a college kid guilty of killing another college kid in a fight. There were more than one, but in the end it came down to the kid on the ground getting kicked in the head which caused his death. I couldn’t convince the rest of the jury on the premeditation due to the alcohol an timing involved, but the kid went to jail for a long time. This WAS attempted murder.
There is no excuse and the officer should be brought up on charges by the prosecutor period. In this case there was no alcohol and even had the driver been drunk there would have been no excuse as he posed no threat. Charges in this case should be preferred.
If I were him, If not too late, I would not accept that settlement, I'd fire my attorney and hire a better one and sue for a minimum, 1 million.
Needs to be said. Most Cops are decent. The one in the video kicking the guy in the head needs to be fired. The cops don’t know what’s behind the wheel until they stop the car then they have to make sure their own life isn’t in danger from the driver. It was obvious the driver was not coherent, but the cops don’t know if it’s because of drugs or a medical issue.
Looks like a typical police operation to me, unfortunately. The only thing missing is the ninja tactical gear. The quality of personnel and the resulting professionalism of their performance has collapsed over the past 35 years to the point where I would prefer to have no interaction with them.
Is the judgement amount of $158,000 taxable as REGULAR INCOME?
It shouldn’t be —the premise is to make the man, “whole”.
Anyone know?
Imagine a dozen of these mental midgets blowing down your front door with automatic weapons, then drilling you with 70 rounds in front of your wife and kid. It happened to a US Marine not along who was allegedly involved in drugs. The SWAT team took care of that drug problem. Next.
Most cops are decent? Really?
Recall the incident in which a concealed-carry guy was not given a chance to announce the presence of his gun. Remember the way the cop repeatedly told him he should simply shoot the man in the head...?
That cop had been cleared by Internal Affairs for citizen allegations against him of exactly THAT type not 3 or 7 of 12 but TWELVE TIMES.....!
After he was fired, he began legal action to be re-instated and ALL the cops at that department donated sick time to pay that creep some money, or something.
THEY ALL SUPPORTED HIM.
Can u believe it...? The entire department was rotten to it’s core.
Now, I realize we have cops on this forum and probably hate reading stuff like that and I can't blame them. Not at all. I'm just sick of cop brutality. And of course the real kicker for me is some cops knew I was completely innocent many years ago but they fabricated evidence and lied resulting in a guilty verdict. So yes, I've been found guilty for a crime I didn't commit and I mention that on occasion here. It still pisses me off.
Henderson SUCKS. They shoot heroes and stomp the sick/infirm. I have a friend who lives there who will not carry. Coming from a state where he was not allowed to a state where he can but it will likely get him killed : (
Court awarded judgments are normally NOT taxable. They are not viewed as earned income, but as a “restoration” payment for injuries, losses, etc.
Why is he settling for $158,000?
After watching the video, $158,000,000 seems more like it.
This is felonious assault.
Why isn’t this cop in prison?
Why doesn’t he lose his home in a lawsuit?
Why should the taxpayers be forced to pay?
Why did the other cops stand around and watch instead of stopping the assault?
They should all serve time in prison for this. This is an unprovoked gang attack by armed thugs who can beat whomever they choose with impunity. This must stop.
The police chief should be forced to resign.
Enough is enough.
