DAYTON A woman is dead following the attempted burglary of a residence on Burbank Drive, according to police.
The woman was fatally shot by the resident of 1932 Burbank Dr., after she broke in to the residence Saturday afternoon and was confronted by a resident of the home. The resident told the unarmed woman to stay put after he discovered her intruding, but the woman threw an object at him. He then shot the woman in the chest using a semiautomatic handgun, according to Dayton Police.
When asked if the resident was justified in firing his weapon, Lt. Kenneth Beall said, Its going to take more investigation and a more detailed interview to make a conclusion like that.
In the eyes of the courts, a mans home is his castle, Beall said. (But) I cant come to that particular conclusion right now in respect to this incident.
The resident was placed in police custody, but has not been charged with any crimes at this point, police said.
The Montgomery County Coroner's Office identified the woman shot and killed as Rovena Turner, 18, of Dayton. Police did not identify the resident.
It appears the two parties did not know each other, according to police.

All my neighbors are wonderful people, he said. We look out for each other, we talk to each other. This does not make any sense.
Same sort of thing was reported yesterday in Dana Point CA..a man was awakened late at night, found a robber in his home and shot him dead..
Long live the 2nd Amendment.
Just sayin, depending on where you are, an unfriendly prosecutor and an unfriendly jury will take advantage of a homeowners predisposition to kill (if they can find evidence of this), as opposed to your natural instinct to survive, which is triggered in the life threatening situation.
I am not criticizing your comment. But I do not recommend airing your comments publically where they could be used against you in court. Advice I would give anyone who makes the decision to keep a gun for self defense.

Amazing that we have to cower before a court to somehow explain away the telling people that I would kill an intruder and then trying to explain away that it's not premeditated. Incredible. Just incredible.
If I can kill the intruder by any means, I'll do it. There . . . premeditated murder. Outrageous.
Instead of shooting her, he could have offered her some weed and discussed with her the possible opportunities for a fulfilling career as a community organizer.
I wonder if the shooter will be charged with a hate crime--it probably depends on whether he is white or not.
The police will talk you into a corner to arrest you. Do not discuss anything
including your feeelings to any cop. Just shut the hell up and find a lawyer.
They can/will take anything you say out of context, then forget everything else
when your day in court comes. So, just shut the hell up.
Police are not your friends.
Situations like this are stressful and the police will try to question you over and over again.
What happens during this stressful time is your adrenalin starts to wear off and you
begin to remember more details.
Details make the story change by adding on to what happened.
When your story changes the police Will turn it over to the DA for investigation and bring charges
against you because they will assume you are lying or hiding something.
Never tell your story to the police, let an attorney do it. And tell the police your
attorney isn't allowing you to talk to them. They will not hold you or your attorney responsible
for doing his job by protecting you against charges.
The police will try to make you talk, and even threaten you with life in prison
for not talking to them. Remember, the police can legally Lie all they want.
Not anymore.
Looks like the courts let this gal down. If they had stuck her with a jail time of any decent length she might still be alive.
Here's to hoping neither of us ever find ourselves having to use deadly force in the first place. Reality is, between legalities and law suits, even a clean shoot will be ugly.

That varies from state to state. In Washington state you can use deadly force anywhere you are legally allowed to be to stop a felony.
Define felony. I dont know if what you say is true or not, but that would surprise me if it is. Most people dont even know what constitutes a felony.
I read the article too quickly. Perhaps the homeowner didn’t have an weed at hand.
Not suprising at how that works. An armed civillian population cures a great many of a society’s ills.

(2) In the actual resistance of an attempt to commit a felony upon the slayer, in his or her presence, or upon or in a dwelling, or other place of abode, in which he or she is.

Felonies include most assaults, theft of over $250, vandalism of over $250, robbery, breaking and entering to name a few. Although I would not want to test it by shooting someone spray painting graffiti on my truck (which would cost more than $250 to repair).
Just the other day here in Washington a guy (prowler?) surprised some older gal as she opened the door to let in her cat. The husband came running to the door to aid his startled wife, saw the guy and killed him. Haven’t heard anything more. I sure hope that the guy on the lawn had a weapon or somehow showed criminal intent, and wasn’t just some guy asking to borrow a snow shovel or something.
And agreed on knowing what the law says. You need to know that stuff so you don’t get into legal trouble, but also so you have a clear idea of when you can and need to use lethal force. When it happens, you won’t have time to think about it.

The link has a news video and comments. Some of the posters claim the deceased has no car, no phone, walks everywhere, and may have gotten caught in bad weather. I sure hope that isn’t the case - both for the deceased and the homeowners.
