WASHINGTON When the companies that supply motor fuel close the books on 2011, they will pay about $6.8 million in penalties to the Treasury because they failed to mix a special type of biofuel into their gasoline and diesel as required by law.
But there was none to be had. Outside a handful of laboratories and workshops, the ingredient, cellulosic biofuel, does not exist.
In 2012, the oil companies expect to pay even higher penalties for failing to blend in the fuel, which is made from wood chips or the inedible parts of plants like corncobs. Refiners were required to blend 6.6 million gallons into gasoline and diesel in 2011 and face a quota of 8.65 million gallons this year.
It belies logic, Charles T. Drevna, the president of the National Petrochemicals and Refiners Association, said of the 2011 quota. And raising the quota for 2012 when there is no production makes even less sense, he said.

Don’t pay the fine and file a federal lawsuit. Dare the fedgov to shut them down. The time has come to take the fedgov to the woodshed, much like the stupid EPA lawsuit about a citizen wanting to build on his property, but the EPA claiming it COULD be a wetland. Sue them into oblivion. Of course, that will only give the Executive branch more reason to hire more lawyers and other bureaucrats.

I would think that would be pretty easy to prove. Like I said above, just ignore the fedgov and/or file a lawsuit.

The only ones to make money in these situations are the lawyers, and they will still have to comply with the law. We have for too long accepted that an idiot bureaucrat or Judge can make law, and Congress has been more than willing to let them.
The Nazi party had about 10% of the population and yet managed to kill 11 million of their own people. We let 541 Congressmen, 100 Senators, 1 President and 9 Supreme Court Justices control a population of 300,000,000, a large portion of which will soon be expendable under health care restructuring.
Will we stand silent as they decide who lives and who dies? We stand silent as they kill 390,000 unborn this year so I suspect we will.

The USDA is instrumental behind the push for cellulosic biofuels. Years ago in an effort to prove “relevance” and worthy of increased funding it began lobbying to be in the forefront of this effort.
Cellulosic ethanol programs in the USDA have had dramatic (taxpayer) funding increases, with NOTHING to show for them.
Its been a dirty little secret that the ability to convert cellulose to ethanol is light years from being economically feasible. No matter. New taxes are collected every year to keep the keep the money flowing.
