Cain Requests That Justice Elena Kagan Recuse Herself from the Supreme Court’s Obamacare Hearing

Republican presidential candidate and businessman Herman Cain today requested that Supreme Court Justice Elena Kagan recuse herself from the upcoming Supreme Court hearing on Obamacare.

As a political appointee in President Obama’s Justice Department, Justice Kagan strongly advocated for the government takeover of health care and during the bill’s debate, then- Solicitor General Kagan actively supported a government-run system and sent a jubilant email to then-Justice Department colleague Laurence Tribe saying: ““I hear they have the votes, Larry!! Simply amazing.”

“I request that Justice Kagan recuse herself immediately from hearing the Obamacare case,” Cain said. “Members of the highest court in the land should be impartial, strictly follow the Constitution and should not carry water for former employers in the White House.”

According to 28 USC 455, Supreme Court justices must recuse from “any proceeding in which his impartiality might reasonably be questioned” and if they have at any time “expressed an opinion concerning the merits of the particular case in controversy” while he or she “served in governmental employment.”

Look, this was discussed yesterday on Greta. What I stated came from Greta and her guest. Check out what constitutes conflict of interest. I would have thought the candidates would be more informed, before pointing fingers with three more pointing back at them. You may not see the conflict but the Democrat Marxists certainly will. They have not recovered from Gore vs. Bush. Reality is what it is. This arguement will die a quiet death because neither side wants to pursue it. This will eventually include Cain. No, I don’t like it either. We need Justice Thomas on this landmark case.

Oh come on, I just complimented Cain on picking something to say, that might not require him to tell us what he really meant to say.

He done good, his polls aren’t really dropping like a rock, he’s rocketing to the top, by golly. LOL

Cain demonstrates leadership.

We hear nothing from whathisname...the speaker of the house...you know that guy that cries all the time, its been so long since I have heard him speak of issues like Kagan, or seen any leadership from him or that other guy in senate...oh whats his name, oh well you know who they are...I’m sure some one out their in freeper land remembers...where are those guys, what happened to them.

I see your overall point of losing two. But it is you that needs a clue not Cain There are a lot of places that oppose Obamacare.Big deal.Justice Thomas’ wife should not reflect Justice Thomas’ decision or recusal. Justice Kagan’s Emails show Kagan had her hand in crafting legal defense for Obamacare.

There is a big difference.It is the MSM that have thrown in that Thomas should recuse.There is a solid case of recusal for Kagan.

Cain needs to get a clue. He surely is informed enough to know that when she recuses, so does Justice Thomas. Mrs. Thomas is gainfully employed by an organization that actively opposes Obamacare, where the Thomas’ by virtue of her employment display a vested interest in the outcome, so the conflict of interest is too obvious in both cases, leaving it a draw. This is a landmark case that needs to be crystal clean at the bench does it not?

What part of "expressed an opinion concerning the merits of the particular case in controversy" did you miss?

Or does your definition of "crystal clean" only include the parts that are convenient to you? And while we're at it, why would you be wanting to throw roadblocks into the path of overturning Obamacare? In general, conservatives see it as an illegal, unconsitutional law for any number of reasons, but especially because it compels purchase of a government product. Do you think that should stand?

I believe that a good many of Americans are going to rush out to vote for a guy they believe can keep Romney out of office and toss Obama out of the White House. They will be voting for Newt Gingrich.

All this other crap is just another nothing burger....

Actually you replied to a remark that I didn’t make, but agreed with @ #28. I have no idea what the standard is for conflict of interest, but was somewhat stunned to hear myself, on GRETA, that “they” are looking at Thomas for a conflict of interest, due to the wife’s employment. Maybe Laura Ingraham will comment since she worked with Thomas at the SC.

My surprise is simply with Cain for not being informed of the Thomas issue before pointing a finger. At least he could have addressed the fact that there two opposing camps exist right now, and both are bubbling on the subject of recusals. As I said, this will die a quiet death since both sides are affected. Cain will go silent also.

Apples and Oranges.

Kagan has direct involvement. She has personally expressed sentiments in favor of ObamaCare.

Justice Thomas has no direct involvement and has not expressed or indicated a preference for either side.

Look, I am all for Kagan going and Thomas staying. Greta and her guest, however, do not agree. They see a clear conflict of interest. They are lawyers. I am not.
