A group of married gay current and former military personnel sued the federal government on Thursday, seeking equal recognition, benefits and the same support as married heterosexual couples who serve in the military.
The lawsuit filed in U.S. District Court in Boston says the government's Defense of Marriage Act violates their constitutional rights and asks the military to recognize their legal marriages.
"This case is about one thing, plain and simple," said Aubrey Sarvis, executive director of the Servicemembers Legal Defense Network, which filed the suit. "It's about justice for gay and lesbian service members and their families in our armed forces rendering the same military service, making the same sacrifices, and taking the same risks to keep our nation secure at home and abroad."

This would be funny if it weren’t so serious...the gay and lesbian issue is being driven by radical extremists who are basically Marxists not American in thought or deed. The OWS is also being driven by anti-American, anti-Capitalism organizations and money people like George Soros hoping to at last destroy America and her freedoms. These people now protesting are the Socialist/communists who have tried for so many decades to take over the American government...if our Congressmen and Senators do not stop them now, they will not be able to stop the radical takeover of America in a short time.

I can see a suit in the future for back pay for “married” gays who served in Viet Nam or even earlier.

They opened the door and they now have no defense and no way to legally deny such benefits.
You can’t say, okay you can serve openly, and then say, okay you two are married, and then say - but you can’t have these benefits.

The bigger problem is that RINOs like McCain joined pro-gay liberals in swearing that DOMA would never be overturned, when the second group was planning to make it happen while claiming it wouldnt. Unfortunately Cheney was probably part of the first group.
The other problem is Republicans couldnt agree, some wanted to ban SS marriage in the states at the Federal level(bad idea) , others wanted to ban domestic partnerships in states at the Federal level(even worse idea) . Attempted over-reach ends in failure to anything.
Instead Republicans should have pushed for a federal law that removes DOMA from the court’s authority to review. It was that simple.

The entire point is that THEY ARE NOT MARRIED. Not according to the federal government and 44 states. Unmarried people do not get the same benefits that married people get. That was the entire point of DOMA as well as every law and constitutional amendment in the vast majority of states.

None of this is surprising... next up will be demands for rights of refusal of deployment to war zones, because after all, we wouldn’t want openly “gay” servicemembers placed in undue jeopardy in muslim countries now, would we.
